Trump Rescinds Obama’s #DACA: Constitutionally It is Right Thing To Do [VIDEO]

When President Pen and Phone Obama scribbled out his orders regarding DACA in 2012, he did it knowing full well that someone else was going to have to deal with the problem he created. While I’m sure he hoped that Hillary would be occupying the White House right now, that didn’t happen. Instead we have a President who has been intent on rolling back numerous onerous regulations and laws that Obama has inflicted upon us all.

Here’s the issue that many refuse to recognize with DACA, and no it’s not the “but the children!” crap, it’s the LEGALITY of DACA. When even Obama’s attorney who helped craft the thing admits it won’t stand up in court…

The tweet thread by Columbus is illuminating in how it essentially makes the case that DACA was problematic from the very beginning. Read it all here.  

Noted legal scholar and Constitutionalist, Andrew McCarthy, has this to say:

The problem is the substance of executive action. DACA is defective in two ways. First, it presumes to exercise legislative power by conferring positive legal benefits on a category of aliens (the “dreamers,” as concisely described in Yuval Levin’s Corner post). Second, it distorts the doctrine of prosecutorial discretion to rationalize this presidential legislating and to grant a de facto amnesty. These maneuvers violated core constitutional principles: separation of powers and the president’s duty to execute the laws faithfully. [Emphasis Added]

By the way, Obama HIMSELF admitted several times that he didn’t have the constitutional power to do what he did with DACA. But he did so anyway in a blatant try for the votes of the DREAMERS’ parents and those DREAMERS now of legal voting age.

Basically, Obama thumbed his nose at this Republic and our Constitution by providing protections to people who are in the United States ILLEGALLY!!

They believed him and did nothing to change their own status. Quite frankly, they had the ability to do so, but they didn’t, and honestly, they have no one else but themselves to blame.

Today, President Trump rescinded DACA.

Needless to say, the gnashing of teeth in the run-up to this decision has been comical, constitutionally incorrect, stupid, and definitely fallen into the fear-mongering category. First out of the gate is this gem:

The response is BOOMTASTIC.

When you get smacked by the Obama and Constitution rake in one response. Ouch. Then Chuck showed up:

Oh I see, Chuck says rescinding #DACA will implode the economy and kill humankind. Wow. Dramatic much?

Then there are those in Congress who are trying to find a work-around while ignoring their own constitutional duties. Tucker Carlson took them to task:

“We’re supposed to believe that this is the ‘conservative’ position, but the only thing it conserves is President Obama’s policy priorities,” Carlson said.

Specifically, the policy priority of DACA put in place by Obama was constitutionally wrong. The Fifth Circuit Court of Appeals said as much. Legal Scholar Jonathan Turley, not really a fan of Trump, but definitely a constitutionalist, was quoted by Sessions in the announcement:

“In ordering this blanket exception, President Obama was nullifying part of a law that he simply disagreed with.….If a president can claim sweeping discretion to suspend key federal laws, the entire legislative process becomes little more than a pretense…The circumvention of the legislative process not only undermines the authority of this branch but destabilizes the tripartite system as a whole.”

In other words, Obama did a major end-run around the entire Constitution. The rule of law and the specific detailing of what each branch of government can and cannot do is there for a reason. President Trump is doing the right thing for the American people, for our Constitution, and for our Republic.

Now Congress must do their job. But will they?

    Regardless of who was in the White House, someone else was going to have to deal with it. That’s what that fence is for. And the wall around 0bama’s house. And gated communities. And tax shelters.
    It was always “someone else” who was going to have to deal with the problem: the taxpayers, the ‘deplorables’, the ‘clingers’.

    Ummm, no. Citing facts not in evidence. (“Working hard to become American” would entail following the law, perhaps returning home so you can apply for entry the legal way.)

    Pfft. He didn’t end run it, he busted right through the center of it, like one of those pep rally signs the players run through. It’s a hollow legalism, now that the people won’t hold the gov’t to account to it.
    The tree of liberty is dying. It needs to be watered.

    I have a few questions. Why haven’t the adult dreamers done anything to do something about their status so they could become legal residents after all these years? Why didn’t the Democratic members of Congress do something about legislation during the previous administration? An executive order is not law. Congress needs to step up to the plate. It seems as if members of congress from all affiliations would rather talk (and talk and talk…) about issues than actually reach a compromise regarding immigration reform.

      Great questions!

      the adults have had multiple opportunities to do so yet a majority didn’t.

      There was legislation during Obama’s first term and into the 2nd. But there was never enough votes from the Democrats let alone the Republicans to make it through the House. And if it did – which I believe one piece of legislation did – make it to the Senate the legislation never made it to the Senate floor. A senate that had a Democrat majority and was led by Harry Reid at the time…

    Why aren’t these “kids” mad at their own parents and country for allowing them to come here? The parents should have known what the consequences could be.
