Trump Indictment: It’s Bad

The Trump Indictment has been unsealed, and there is a great deal to unpack in it. As reported by The Hill:

The Justice Department on Friday unveiled a 37-count indictment against former President Trump over his handling of classified materials after leaving the White House, offering up an expansive look at the evidence prosecutors collected.

The 49-page document provides significant insight into the nature of the classified documents Trump had kept since leaving the White House in January 2021, allegations about Trump’s moves to obstruct attempts to retrieve the documents and details about instances where Trump is said to have openly shared sensitive government secrets.

Here are the highlights of the charges in this indictment:

Trump is alleged to have moved multiple boxes containing highly classified military information to Mar-A-Lago at the end of his term. 

Trump is alleged to have shown people who have NO security clearance classified military secrets. 

Photo evidence shows boxes on the stage at Mar-A-Lago, bathrooms, bedrooms, and other closets. 

Trump is alleged to have moved boxes to his other residence at Bedminster Golf Club

Trump is alleged to have ordered aides to move boxes so investigators won’t see them. 

Trump’s valet is indicted as a co-conspirator in this case. 

Those are the top line highlights of this indictment. I urge all our readers to read the entire indictment thoroughly, which you can find here or here. Rather than rely on the media and politicians cherry-picking, read it in its entirety. 

The prosecutor, Jack Smith, gave a statement. 

If you watched the entire bit, which wasn’t very long, did you catch one thing Smith said?

Special counsel Jack Smith, who brought the charges against Trump and Nauta, said in brief remarks on the indictment, “We have one set of laws in this country and they apply to everyone.”

So, here’s a glaring example of the two-tiered justice system I wrote about earlier this morning. According to Jack Smith, our Republic’s laws apply to EVERYONE. Oh REALLY?

I’ll get back to that part in just a minute. Here’s why this indictment is bad. While the prosecutors have to PROVE these charges, the fact is, nothing in this indictment is a good look for Trump nor anyone close to him. None of it. 

His own quotes concerning classified documents and other issues are being leveraged against him. The fact that there are photos and tapes of Trump discussing classified materials with people is beyond atrocious. 

Why in the ever-loving hell did he DO THAT??!! I can’t think of any legal defense for this. Maybe Trump’s new attorneys can, but I just don’t know if it is possible. 

How do you counter the prosecution when the indictment also includes information pertaining to his previous attorneys and their role in this?

The indictment details multiple incidents in which Trump pressured his lawyers to withhold documents from the government, including asking them to tell authorities he did not have them.

In another instance he suggested his attorney “hide or destroy” the documents that were being sought by a May 11 subpoena seeking the return of all classified records.

This and more is why this indictment is bad for Trump and really bad for this Republic. 

Keep in mind, people have been on a nearly eight year witch hunt against Donald Trump. They have been searching for anything and everything they can to run against him and get him into prison or at the very least, keep him from getting elected again. However, as Legal Insurrection’s William Jacobsen (a brilliant attorney) points out, 

The second thing that can be true at the same time, depending on what the evidence shows, is that Trump may have given the prosecutors just what they were looking for as to what Trump did with the documents in question once he knew that the feds were seeking the return of the documents.

I absolutely agree. Moreover, Jonathan Turley believes this indictment is damning.

I would also submit it is dangerous to us all. I go back to Jack Smith’s statement above. 

According to him, the rule of law is to apply equally to EVERYONE. Does it? Does it really?

Yes, it is a valid question. If the rule of law applies equally to all, then why did James Comey halt the investigations into Hillary Clinton? Why were the contents of Hunter Biden’s laptop suppressed? Why was the FBI refusing (and facing contempt charges) to hand over not one but THREE FD-1023 forms relating to the Bidens, bribery, corruption, and Burisma? Also, Biden and other presidents held on to documents they shouldn’t have. 

The law SHOULD apply equally to all of them no matter the instance. But it doesn’t and it isn’t. 

Quite honestly I’m so angry right now. Trump brought this shit show upon himself because of his OWN arrogance and lack of self control!

This turns the election season into one helluva circus. A circus this country does NOT need. 

Third, I’m very afraid our justice system will be further weaponized as this case moves forward. And that’s not good for anyone. 

This indictment is bad. It’s bad for Trump. But it’s REALLY bad for the future of this Republic.

    Agreed on all points Nina. This looks really bad for Trump, and if he was this careless with classified documents, he should face the repercussions. Also true that both biden and clinton should have long ago faced justice for their crimes, and until they do, it is a two-tiered corrupt system that needs to be gutted and rebuilt.

    I’m going to give the 280 pound malignant tumor the benefit if the doubt here and assume he wasn’t collecting military and nuclear secrets to leverage for his personal gain (and that’s a big “benefit of the doubt”). I’ve said this a million times about TFG (the f*&king genius), he has this immense need to “brag.” He loves disclosing stuff that he knows and no one else knows. We’ve all been there before on a much smaller basis … “I have a secret and you don’t know it.” TFG’s need to brag and bloviate is intense … it’s his Achilles heel.

    I have no idea what Hunter Biden’s laptop holds (there are at least five hundred copies of his laptop floating around the internet so there’s very little reason to believe any of that “data” is infected … yeah, right), and Hillary has been scrutinized and paid the price for her “reckless” handling of confidential records.

    Pundits on both sides have made this point about TFG’s reckless handling of classified information … it’s an affront to every military and intelligence member in America who put their lives on the line every day to keep all of us safe … TFG has basically shit on every one of them, past and present. Nice job.

  • The main assumption that you have to make here is that any of the “evidence” is actually evidence. This regime has proven, over and over again, that they are quite comfortable and capable of creating whatever they need for their purposes out of whole cloth.

    We are faced with a group of would-be tyrants that has just as little moral compunction as any of the Soviets or National Socialists. Anything coming from them must be immediately suspect.

    Putting aside the merits (or lack thereof) of the indictment – Trump is completely unelectable in a general election. It is long past the the time to move on from him, and for so many reasons starting with his temperament, poor judgement, and advanced age. Even if he were by some miracle victorious in 2024 he would be a lame duck from Day 1 with an inability to govern and given his toxicty who would agree to work for him starting with who would he pick to be his V.P.? Maybe Sarah Palin, Jim Jordan, Matt Gaetz, Kari Lake etc. Good luck with those choices. In fact he would have a hell of a time getting cabinet members to be approved by congress and he would ultimately have a cabinet staffed with sycophants and weirdos.

    • My usual question – just who IS electable in the general election? I.e., one who can garner enough votes to not only win, but overwhelm the fraud machine?

      Given my druthers, I would like to see Ramaswamy, Scott, DeSantis, and then only Trump, in that order. But the first two have not a chance in Hell. DeSantis very unlikely – the machine is already gearing up to take him down by any means necessary. Not to mention that ANYONE who “sees no fraud, hears no fraud, speaks no fraud” – is going to be clueless and bewildered when they lose after being up by double digits before the wee hours of the morning when the observers have all been sent home.

      In any case, I don’t think that a “weirdo” Trump Cabinet member can possibly manage the standard set by any of the Biden Cabinet.
