DOJ Threatens Texas With Lawsuit Over Immigration Law

Biden’s DOJ does NOT want illegal immigration law enforced on our southern border. The DOJ made that abundantly clear with the letter threatening a lawsuit that Texas received yesterday.

The Biden administration on Thursday warned Texas that it will sue the state if it implements a strict immigration law known as SB4 that would empower state and local law enforcement officials to arrest, jail and prosecute migrants suspected of entering the U.S. unlawfully.

The Justice Department said it would file a lawsuit against SB4 if Texas did not assure federal officials by Jan. 3 that the state would refrain from enforcing the law as planned in March, according to a letter sent to Gov. Greg Abbott on Dec. 28 and obtained by CBS News. In addition to creating illegal entry crimes at the state level, the law would allow Texas judges to issue de facto deportation orders.

This country is seeing at least 10,000 illegal immigrants showing up at our borders PER DAY, and what does the DOJ do? Threatens to sue Texas for trying to secure our borders. 

No, I’m not kidding. Here’s the letter. 

According to the DOJ, SB4 violates the U.S. Constitution, and that it’s Congress who has set in place the very “comprehensive scheme” to handle entry and deportation of non-citizens. Therefore, the DOJ’s reasoning is that they know all, thus Texas cannot be allowed to enforce A. their own laws and B. the Constitution! And finally, since acceptance or removal of “noncitizens” hinges on U.S. foreign policy, the piddly State of Texas needs to stay in their lane. 

Let’s have a look at what Texas and therefore our country is dealing with right now, shall we?

Repeat after me, TEN THOUSAND A DAY. And that’s the ones we know about. How many are getting away? How many have slipped through while our Border Patrol is stretched so thin that they’ve had to shut down crossings and pull their resources? Too many I fear. 

A few other things to note while we are discussing the DOJ’s threat against Texas. The U.S./Mexico meeting ended up with the idea of amnesty being floated once again. 

The two countries reaffirmed their existing commitments on fostering an orderly, humane, and regular migration. This includes reinforcing our partnership to address the root causes of migration, such as poverty, inequality, and violence, and for the two countries’ initiative for Cubans, Haitians, Nicaraguans and Venezuelans. Ongoing cooperation also includes enhanced efforts to disrupt human smuggling, trafficking, and criminal networks, and continuing the work to promote legal instead of irregular migration pathways. Also, both delegations agreed on the importance of maintaining and facilitating the vital bilateral trade at our shared border.

Notice who is not listed? Those who are showing up from China, the Middle East, and Africa by the hundreds. As we know already, some on terror watch lists have been nabbed. I shudder to think of whom our border patrol missed because they are overwhelmed. 

But back to that so-called fruitful meeting and the results therein. Oh, let’s just call it what it is. Amnesty for all! Well, for many anyway. 

Exactly. Texas especially, but Arizona, New Mexico, and California also are being overrun by illegal immigrants. Our betters at DHS and the State Department insist that this is only a blip of irregular migration, and they just know how to fix things. 

“The U.S.-Mexico partnership is crucial to prosperity and security in our countries and throughout the Americas,” Blinken wrote. “Good to discuss these issues, and our shared efforts to reduce irregular migration, with [López Obrador] today in Mexico City.”

“Irregular migration.” WOW. Talk about parsing words to ensure the reality of the situation is brushed off. 

Sixteen busloads of illegal immigrants were dropped off in Denver, Colorado just before Christmas. My husband and I witnessed entire families traipsing through traffic begging for handouts. Illegals are being housed at O’Hare airport. Eric Adams is throwing a fit and many sanctuary city mayors are declaring that their cites are overwhelmed and at capacity. 

Again, 10,000 PER DAY are coming through our borders. Many of whom are given NTA’s (Notice to appear) court dates three-five years from now. Immigration courts are so overwhelmed, they have a backlog of THREE MILLION cases. 

What it boils down to is this; if the federal government, is shirking their duties, then it falls to the states to enforce the Constitution and protect their citizens. 

However, there are those who don’t believe Texas should be involved.

“Asking local police to hunt down Texans who look like immigrants doesn’t make us safer: in fact, it takes police away from investigating real crime,” U.S. Rep. Greg Casar, D-Austin, said in a statement. “The federal government must block this unconstitutional anti-immigrant policy before it takes effect.”

What an absolutely asinine statement. This is what Texas has been doing for the last two years.

Here’s the crux of this: The DOJ, by threatening to sue Texas, has really said the quiet part out loud. Our federal government betters aren’t interested in protecting this country. At. All.

    Hmmm, seems my answer would be (after saying “Bring it, Big Guy!”) to state that the state of Texas does not pass laws it doesn’t intend to enforce – unlike the feds.

    And… you’re not enforcing it. So you’re failing in one of the prime duties of the federal gov’t.
    Which makes secession moot. We didn’t leave America, Washington, DC, left us.

    But there’s the whole problem. There isn’t supposed to be a “regular migration” outside of the legal means of entry. People aren’t supposed to come here without a visa and by following the rules.

    The causes are irrelevant. That’s for those folks to figure out in THEIR country. We are NOT the global dumping ground for disaffected people.

    Ah, but Grasshopper, the States are no longer sovereign now that the Constitution has been abrogated. They’re just administrative divisions within the People Republic of America. According to Progressive doctrine, all power must be consolidated so that none might make the “wrong” decision. You will eat your gruel, peasant, because we’re in the process of making the greatest, grandest utopian omelet the world has ever seen.

    Biden is destroying America.
    No, Abbott, that’s where you’re wrong. Biden can’t even destroy his pudding. It’s the larger, overall, pervasive Progressivism that is destroying America. Because it is so pervasive, you can’t vote your way out of it. It will take a wholesale revolution of worldview among the electorate to restore a free Republic. The folks destroying America are the leaders of Progressivism in academia, the bureaucracy, government, and the media.

    Your law (despite it being what’s needed right now) will not fix things. But it’s a good way of standing up to our “leaders” and telling them to start doing their jobs.

    I fully expect Texas to lose the lawsuit because Progressive lawyers (and many conservative ones) are absolute idiots pedants regarding precedent and other twistings of the law. Also, too many “Hawaiian” judges.
