According to NPR, and all the rest of the left-leaning media, there’s been a huge mask flap at SCOTUS. You see, according to NPR, Justice Neil Gorsuch refuses to wear a mask, which is why Justice Sotomayer attended recent court sessions via teleconference.
Here’s how NPR reported the “mask flap.”
It was pretty jarring earlier this month when the justices of the U.S. Supreme Court took the bench for the first time since the omicron surge over the holidays. All were now wearing masks. All, that is, except Justice Neil Gorsuch. What’s more, Justice Sonia Sotomayor was not there at all, choosing instead to participate through a microphone setup in her chambers.
Sotomayor has diabetes, a condition that puts her at high risk for serious illness, or even death, from COVID-19. She has been the only justice to wear a mask on the bench since last fall when, amid a marked decline in COVID-19 cases, the justices resumed in-person arguments for the first time since the onset of the pandemic.
Now, though, the situation had changed with the omicron surge, and according to court sources, Sotomayor did not feel safe in close proximity to people who were unmasked. Chief Justice John Roberts, understanding that, in some form asked the other justices to mask up.
They all did. Except Gorsuch, who, as it happens, sits next to Sotomayor on the bench. His continued refusal since then has also meant that Sotomayor has not attended the justices’ weekly conference in person, joining instead by telephone.
And, of course, the crowd went wild. Neil Gorsuch is a horrible man! He’s putting lives at risk! Specifically, he doesn’t are about Justice Sonia Sotomayor’s health! He’s a Covid killer! HOW DARE HE??!!!
Keep in mind, NPR also tries to paint Justice Gorsuch as the most divisive judge on the bench. Evidently no one likes him and they all are getting mighty tired of the questions he asks during court sessions.
See? NPR is telling us that Justice Gorsuch as not only a wicked Covid-killer, but also describing him as that kid in school who manages to alienate everyone.
However, and you knew this was coming, there’s a great deal more to this mask flap story that NPR is peddling. First of all, why is NPR writing such divisive drivel? I’d have to say that they aren’t thrilled with the SCOTUS decisions regarding the OSHA mandates. Justice Gorsuch was definitively not a fan of such massive government overreach.
The main issue for the Court wasn’t the policy question of vaccine mandates. It is, as Justice Neil Gorsuch pointed out in a concurrence, who decides on the policy: “The answer is clear: Under the law as it stands today, that power rests with the States and Congress, not OSHA.”

The Court must “enforce the law’s demands when it comes to the question who may govern the lives of 84 million Americans,” Justice Gorsuch wrote in his concurrence. “Respecting those demands may be trying in times of stress. But if this Court were to abide them only in more tranquil conditions, declarations of emergencies would never end and the liberties our Constitution’s separation of powers seeks to preserve would amount to little.”
I couldn’t agree more. The OSHA mandate was a total end-run around Congress and most certainly took a sledgehammer to States Rights. Thus, I honestly believe that NPR decided to come up with this hit piece. All while trying to protect Justice Sotomayor from her own wild lies and Covid stats that even the CDC and Washington Post called her out on.
Now, there’s more information regarding this mask flap. And, it’s looking a lot like FAKE NEWS.

As someone who has participated in many a Zoom/teleconference call over the last two years, I can tell you that setting something up on the fly isn’t a thing.
Maybe Stern and his wife, along with NPR and the complicit media are spreading misinformation on purpose? Sounds like CNN is hiring their new “misinformation team” just in time!
All this “mask flap” because SCOTUS didn’t rule the way the media and Democrats demanded they should regarding the OSHA mandates.
