There are two justice systems in this country. If you are a January 6 protester, it’s solitary confinement for you. If you are a member of the Deep State Managerial Class, you can get fired for cause, avoid prosecution and get your full retirement benefits. Ladies and gentlemen, I give you Andrew McCabe.
If you are not a political junkie and you did not follow every pretzel twist and S-curve of the Trump Russia Collusion story, here is a little background on Andrew McCabe. McCabe was Deputy Director of the Federal Bureau of Investigations, under Director James Comey. Comey allegedly promoted McCabe to Deputy ahead of more qualified personnel. After Comey was fired, McCabe was Acting Director until (uh) Christopher Wray was brought in. As Deputy Director, McCabe was read in on the Clinton server and email investigation and Crossfire Hurricane, the investigation of the Trump Russia Collusion.
Andrew McCabe had been suspected of leaking information to the Wall Street Journal. The Office of the Inspector General (OIG) opened an investigation into McCabe’s actions. The report, issued in February, 2018, found that McCabe had a “lack of candor” under oath and not under oath. From an ABC report on the OIG report:
The inspector general began investigating McCabe in August 2017, after the FBI’s Inspection Division told the inspector general’s office that the deputy director may have lacked candor when questioned about his role in disclosing sensitive information to a reporter.
In its report released Friday, the inspector general’s office said McCabe “lacked candor” in July 2017 when he told investigators – under oath – “that he was not aware of [the FBI attorney] having been authorized to speak to reporters around October 30,” and he “lacked candor” again four months later when he acknowledged authorizing the disclosure but “stated that he told Comey on October 31, 2016, that he had authorized the disclosure to the WSJ.”
Andrew McCabe was fired the next month, March 2018, days before he was due to retire. The Department of Justice declined to prosecute McCabe (pity) and McCabe sued the DOJ to get his pension and benefits restored.
But, McCabe didn’t shut the heck up. He still smeared President Trump. As Nina wrote, in February, 2019, McCabe went on CBS’s 60 Minutes and bragged about meetings in which the principals discussed using the 25th Amendment to get rid of Trump. From Nina’s post:
Via Legal Insurrection’s William Jacobsen:
Former acting FBI Director Andrew McCabe in a new interview reveals new details of the investigations into President Trump, telling CBS that there were conversations about the possibility of removing Trump under the 25th amendment and confirming that Deputy Attorney General Rod Rosenstein had offered to wear a wire around the president.
McCabe spoke to “60 Minutes” for an interview ahead of the release of his book, “The Threat: How the FBI Protects America in the Age of Terror and Trump.”
CBS News’ Scott Pelley appeared on “CBS This Morning” Thursday to discuss his interview with McCabe, saying that McCabe told him about the efforts to figure out “what to do” with Trump during the eight days between the firing of then-FBI Director James Comey and the appointment of special counsel Robert Mueller.
“There were meetings at the Justice Department at which it was discussed whether the vice president and a majority of the Cabinet could be brought together to remove the president of the United States under the 25th Amendment,” Pelley said Thursday. “And the highest levels of American law enforcement were trying to figure out what to do with the president.”
Pelley said that McCabe told him Deputy Attorney General Rod Rosenstein offered multiple times to wear a wire in meetings with Trump.
Last evening, an agreement was reached between McCabe and the FBI, he gets all his benefits and his firing is erased from his file. From the New York Times:
On Thursday, the department reversed Mr. McCabe’s firing, settling a lawsuit he filed asserting that he was dismissed for political reasons. Under the settlement, Mr. McCabe, 53, will be able to officially retire, receive his pension and other benefits, and get about $200,000 in missed pension payments.
In addition, the department agreed to expunge any mention of his firing from F.B.I. personnel records. The agreement even made clear that he would receive the cuff links given to senior executives and a plaque with his mounted F.B.I. credentials and badge.
The Justice Department did not admit any wrongdoing. But the settlement amounted to a rejection by the Biden administration of how Mr. McCabe’s case had been handled under Mr. Trump, who perceived Mr. McCabe as one of his so-called deep-state enemies and repeatedly attacked him. A notice of the lawsuit’s dismissal was also filed in federal court.
And, the January 6 protesters are still in solitary confinement.
Andrew McCabe is currently a CNN law enforcement analyst so he ran right to Anderson Cooper to tell his (sob) story:
Oh, call the whaaambulance. He gets his job back, his pension and back pay. Plus, they will make a plaque with his badge on it. Where do the January 6 protesters go to get their lives back? McCabe said he misspoke under oath and when he realized it, he immediately corrected the record. Tell that to General Michael Flynn. McCabe says that his family should never had had to go through this. Tell that to the January 6 protesters’ families and the family of General Flynn. And, McCabe went after Trump again:
‘It was so bizarre. To know that you have a target on your back from the most powerful person in the world … it was upside-down world. I can’t even describe how terrifying and annoying and humiliating it is. That’s what he subjected people to for four years,’ McCabe said.
He added that he blames not just Sessions, but the rest of his DOJ and the FBI for the original decision. He hopes this judgement in his favor prevents it from happening again.
Yes, I hope this never happens again. The Deep State Managerial Class needs to go. If there were any justice, Andrew McCabe would be breaking rocks in the Graybar Hotel for a very long time.
