The former FBI director and giant weirdo, James Comey, could be under indictment very shortly.
Now, we do know that this is something that President Trump wants to happen, thanks to his now-deleted Truth Social comment that read like an email to Attorney General Pam Bondi. He specifically referenced Comey in his short list of people that he wanted something “done” about.
The president grumbled that former FBI director James Comey, Sen. Adam Schiff (D-Calif.), and New York Attorney General Letitia James (D) are all “guilty as hell, but nothing is going to be done.”
“I have reviewed over 30 statements and posts saying that, essentially, ‘same old story as last time, all talk, no action. Nothing is being done. What about Comey, Adam “Shifty” Schiff, Leticia???,’” Trump groused in the Truth Social post.
While Trump may be impatient, there is good reason to move right now regarding Comey. The statute of limitations on the charge being investigated is set to run out next week.
The probe into Comey centers on whether he lied to Congress during his Sept. 30, 2020, testimony about his handling of the investigation into Russian interference in the 2016 U.S. presidential election.
Under federal law, prosecutors have five years to bring a charge, with the five-year mark occurring next Tuesday. The case is being handled by the U.S. Attorney’s Office for the Eastern District of Virginia.
“DOJ officials are close to deciding whether to prosecute former FBI Director James Comey for allegedly lying to Congress in September 2020,” a source said. “There is a grand jury underway looking at the matter in Virginia. A decision could come any day.”
The extent of the potential charges was unclear, as was which part of his testimony could be subjected to perjury charges.
Apparently part of the question revolves around the charges themselves. Lindsey Halligan, the brand new federal prosecutor in the Eastern District of Virginia, is apparently putting the case together quickly in order to have it done by next Tuesday.
Even if Ms. Halligan meets her deadline, there is no guarantee the grand jury will determine that the government has met the evidentiary threshold to indict Mr. Comey.
It is not clear if a career prosecutor would be willing to present the case to the grand jury — or if Ms. Halligan or another Trump-allied political appointee would appear in court.
“Perjury is a very difficult crime to prove,” said John P. Fishwick, who served as U.S. attorney for the Western District of Virginia from 2015 to 2017. “The department must show that a particular statement was false and that the defendant knew it was false at the time he or she testified. Because of the difficulty of proof, it is not often pursued.”
Career prosecutors in the Eastern District of Virginia investigated Mr. Comey and informed Mr. Trump’s political appointees at the Justice Department that there was insufficient evidence to obtain a conviction, according to several people briefed on those discussions.
Now, Comey clearly has made a series of decisions over the years that led to not only his firing by President Trump during his first term, but has also shown that he has excruciatingly bad judgment, like posting apparent threats spelled out with seashells and gushing over Taylor Swift like a millennial. He received nothing but scorn from Democrats over the 2016 election and the handling of Hillary’s emails, yet allowed “Crossfire Hurricane” on his watch. In short, he has friends only because he loathes Donald Trump – and he may have leaked this story to the media himself.

Naturally, the media decided that this was a revenge hit by Trump to “get” Comey. And while Trump would dearly love the optics of a Comey indictment (no one doubts that), shouldn’t there be consequences if Comey can be proved to have lied to Congress?

Will Comey be indicted? The clock is ticking, so whatever can be presented to a grand jury needs to get put up now. Will the indictment stick? It depends on whether the DOJ can prove that Comey knew he was lying, and what specifically they are accusing him of lying about. We’ve had a whole host of material be uncovered regarding the Russia investigation – is there something in there that can definitively prove that Comey lied to Congress? We have until next Tuesday to find out.
