Dobbs was the right decision says Justice Amy Coney Barrett in her upcoming memoir: “Listening to the Law: Reflections on the Court and Constitution.” And, of course, that’s going to spin up liberals. Cue the tantrums again!
Via The Hill, here’s what she has to say in her book.
Supreme Court Justice Amy Coney Barrett in her upcoming memoir defends the High Court’s decision in 2022 that reversed decades of abortion rights protections, writing that the court had actually gotten “ahead of the American people” with its landmark 1972 Roe v. Wade ruling.
“The evidence does not show that the American people have traditionally considered the right to obtain an abortion so fundamental to liberty that it ‘goes without saying’ in the Constitution,” Barrett wrote in her forthcoming book, according to a report from CNN based on advance excerpts. “In fact, the evidence cuts in the opposite direction. Abortion not only lacked long-standing protection in American law – it had long been forbidden.
Abortion has long been touted as a “Constitutional right” by liberals ever since the Roe v. Wade ruling. However, the ruling never actually RULED it was a right enshrined in our Constitution. Furthermore, it essentially told states that their laws forbidding abortion were wrong.
The Dobbs decision RETURNED that right back to the states. Essentially each state has now been given back the authority to decide whether abortion is legal or not. The pro-abortion crowd doesn’t want anyone to realize that.
Justice Amy Coney Barrett has a new memoir out, so naturally CNN's Supreme Court analyst Joan Biskupic had to trash the part where she defends overturning Roe v. Wade, "In fact, what she was saying is it sort of flouted the democratic process. But as you know, the Constitution is… pic.twitter.com/1uTBvGqA1U

So this coming from Justice Barrett’s book is certain to make their heads explode.
Barrett backs up her contention that the Supreme Court was “getting ahead of the American people,” in the 1973 Roe decision by citing the woman she succeeded on the bench: “Justice Ruth Bader Ginsburg, herself a supporter of abortion rights, observed nearly twenty years after Roe that the case may have ‘halted a political process that was moving in a reform direction,’ ‘prolonged divisiveness,’ and ‘deferred stable settlement of the issue.’”
Abortion opponents have often used pieces of a 1993 Ginsburg speech to support their cause. Alito similarly cited Ginsburg in the Dobbs opinion.
But Ginsburg, one of the court’s strongest believers in women’s equality and the right to end a pregnancy, said Roe’s result was correct, even as she held a nuanced assessment of how broadly the court swept and the constitutional grounding it chose.
In her book, Barrett dismisses the view of the three liberal Dobbs dissenters, who began their opinion by declaring – and citing Ginsburg – that for half a century the court’s abortion-rights precedent “protected the liberty and equality of women” and guaranteed “government could not control a woman’s body or the course of a woman’s life … .”
Barrett writes that the “complicated moral debate” about abortion distinguishes it from other rights more traditionally recognized as fundamental that enjoy broad public support, including “the rights to marry, have sex, procreate, use contraception.”
Needless to say, abortion doesn’t protect liberty and equality for the unborn child who is killed. Furthermore, no matter what the detractors say, Dobbs doesn’t control women or their bodies. It just put the decision concerning abortion BACK into the states hands.
She’s certainly been defying expectations in the last five years. Certainly her writings and opinions have raised eyebrows across the spectrum at times. Her smackdown of KBJ was a thing of beauty.
That said, it will be fun to watch the tantrums for the next few days.
Amy Coney Barrett is a LIAR. Before her confirmation, she claimed she would not contest Roe v Wade. Simply put, it was law. The other two also lied.

Leslie’s having a normal one I see. Others are trying to claim she’s whining about how her vacation was ruined after the Dobbs decision. They are all wilfully forgetting that she along with other Justices have been having to live with heightened security patrols (which Biden refused for a time), vile protests at their homes, and threats on their lives.
Justice Barrett from the very start pledged to uphold the law and the Constitution while on the Supreme Court.
She has this to say in her book:
Swearing to apply the law faithfully means deciding each case based on my best judgment about what the law is. If I decide a case based on my judgment about what the law should be, I’m cheating.”
In other words, when Dobbs came before the court, she looked at the laws involving that specific case, and let THAT rather than her personal opinions inform her vote.
Thus, while we may not agree with all her votes and opinions, as long as she holds to the above, we can be assured she’s adhering to the laws of this country and not ruling on what she thinks or wants it to be.

“…we can be assured she’s adhering to the laws of this country and not ruling on what she thinks or wants it to be.” Unlike a certain other justice with a hyphenated two last names who believes her “feelings” are more important than the laws.
The law is very clear, and foundational. The Tenth Amendment. The Federal Government does not have authority to define homicide outside of its Constitutional bounds – that is reserved to the States.
