How interesting that on a day when mad spin is coming from the press about motives for mass shootings, Sarah Palin gets a second chance at taking The New York Times to court.
If you don’t remember, the left has long claimed that the mass shooting at former Representative Gabby Giffords’ public meet-and-greet was a direct result of Palin’s PAC placing a “target” on Giffords’ district for that election cycle. This canard was revived in the wake of the Congressional baseball shootings by the NYT, who first smeared Palin for the Giffords shooting, then offered a tiny correction in the hope that it would save them from being sued. Palin considered her options and sued.
A lower court in New York dismissed the lawsuit, but now, over two years later, the defamation suit is back.
The 2nd Circuit Court of Appeals on Tuesday ruled that Sarah Palin can move forward with her defamation lawsuit against The New York Times, two years after a lower court judge dismissed the case.”
Palin had sued the newspaper for defamation over an editorial that tied an ad from the former Alaska governor and GOP vice presidential nominee to the 2011 shooting of former Rep. Gabrielle Giffords (R-Ariz.).”
The three-judge appeals panel found that Palin’s case had wrongly been dismissed and that her lawsuit “plausibly states a claim for defamation and may proceed to full discovery.”
They sent the matter back down to the Southern District of New York for further proceedings.”
While this case is a long way from being settled – and of course, the Times is planning on fighting it – odds are good that Palin and her legal team get to present their side to a jury.

And it is fascinating to have this news breaking at the same time that the media is trying to blame Donald Trump for El Paso, but forbidding any kind of association of Elizabeth Warren and Bernie Sanders for Dayton. The double standard is blatant, and it’s unhelpful.
2. If the shooter sans manifesto had plastered social media with Trump support and followed conservatives, the media would blast that fact out there incessantly, and implicate his politics. In fact, many would blame the right without any such connections (see Giffords/Palin).

It’s also amazing that the Palin news breaks on the same day that the NYT actually re-wrote a headline in the print edition because it was too upsetting to the left that they accurately reported what President Trump said at his presser yesterday. God forbid that the headline (i.e. the clickbait) actually reflect the truth! And the old media wonders why they are dying out.
The left is continually moving the goalposts, because they want to keep blaming Trump. But this process started a long time ago, even before their reach to link Sarah Palin to the Giffords shooting. When only one side can be at fault for a mass shooting, and the media runs cover for the other side, we can’t have unity or any kind of trust in those who are supposedly “reporting” the news to us.
Now, this defamation case still has a long way to go, and could still be dismissed again. But given that the Covington case is now hanging in the balance due to a single judge’s ruling, it’s interesting to see the Palin case swing back into the spotlight. I keep hoping that at some point, a media outlet is going to be forced into a judgement so large, or so embarrassing, that it will serve as a warning to others (as the Oberlin case should serve as a warning to other colleges). I thought it would be Covington. But maybe it will be Palin. And wouldn’t THAT be the media’s just desserts if Sarah Palin ends up being their comeuppance.
