And now the bathroom wars are moving into the school district near you. The Obama administration, under the direction of the president, will be issuing an imperial decree about how schools are now to treat transgendered students.
A letter to school districts will go out Friday, adding to a highly charged debate over transgender rights in the middle of the administration’s legal fight with North Carolina over the issue. The declaration — signed by Justice and Education department officials — will describe what schools should do to ensure that none of their students are discriminated against.
It does not have the force of law, but it contains an implicit threat: Schools that do not abide by the Obama administration’s interpretation of the law could face lawsuits or a loss of federal aid.
Remember: it does not have the force of law. This is a declaration by administration officials, done with the approval of the president. It is a threat. It’s a threat along the lines of, “Say, nice school you have here… be a shame if something happened to it.” This is nothing more than blackmail. Comply, or ELSE.
Comply, despite the statement from the American College of Pediatricians which said that “gender ideology harms children.” Comply, even though juvenile sex offenders are allowed to attend public schools, though laws vary by state. (This has been in the news again locally within the Seattle area, though the student in this case was not convicted, but was expelled from a private school for a sexual assault, before enrolling in a public school.) Comply, although there may be abuse survivors attending public schools who deserve privacy and protection. Comply, even though “Woman of the Year” Caitlyn Jenner is reportedly considering becoming Bruce again.
Ed Whelan, writing in National Review, recently pointed out that this entire bathroom chaos being forced upon schools has created a Title IX ouroboros – the law is literally devouring itself in the legal attempt to stretch discrimination protections to transgendered students.
The unsound proposition that separate facilities assigned by biological sex involves discrimination on the basis of gender identity collapses into incoherence. If a boy who identifies as female has a right under Title IX to use the girls’ restrooms and showers, then it would clearly be discrimination on the basis of gender identity to bar a boy who identifies as male from also using them. After all, the difference between these two biological males is that they have different gender identities. How could one of the males be allowed to use the girls’ facilities and the other be barred from doing so if Title IX bars discrimination on the basis of gender identity? In short, contrary to everyone’s (including the Obama administration’s) understanding of Title IX, the transgender illogic would disallow any system of single-sex facilities to survive.
This chaos is most certainly headed for the courts, as Texas Governor Greg Abbott declared his intent to fight the Obama Decree.

Buckle up, everyone. There are still eight months left in the Obama administration, and he’s not likely to forget that he has a pen and a phone.

If it doesn’t have the force of law, then what would be the basis for any lawsuits? The gov’t doesn’t get to just toss torts around. They have to be based in a law. At least in a country based on Rule Of Law. It’s even illegal to withdraw funding unless the violation is found in LAW.

Like hell he isn’t! Congress began abdicating their Constitutional duties decades ago. 0bama is just the culmination of that. Half of our judiciary has abdicated their role, as well (while the other half seems to want to expand their reach). We no longer have a representative republic – we’re a democratic monarchy. And it won’t matter who is elected President in November, that trend will worsen.
The ballot box can no longer protect our rights and our freedom. The jury box still has some potency – when the PTB bother to indict lawbreakers. How many boxes are left?

If the states don’t fight this (even tho it isn’t law), 0bama will take it as a capitulation and will continue. He must be fought regardless of the legalities.
