Daniel Penny is the young man, a retired Marine, who subdued Jordan Neely on a NYC subway in early May is now facing manslaughter charges from District Attorney Alvin Bragg.
Daniel Penny — the former Marine who put homeless man Jordan Neely in a deadly chokehold on the subway last week — will surrender to face criminal charges on Friday, law enforcement sources with knowledge of the case said Thursday.
Penny, 24, will turn himself in at the NYPD’s 5th Precinct in Chinatown on Friday morning, high-ranking police sources said Thursday. He will be arrested on a criminal complaint charging him with second-degree manslaughter, which could carry a jail term of up to 15 years, according to prosecutors
The case is murky and is a political hot potato on a number of fronts. If you believe Jordan Neely’s family, Democrat politicians, and all the protestors, Jordan Neely was just a sweet guy who loved to imitate Michael Jackson.
So, what happened? According to media reports, Neely was not only causing a disruption, he was menacing subway riders.
Dramatic new video shows a straphanger taking matters into his own hands, pinning down an unhinged man in a deadly incident at a Manhattan subway station this week.
The 24-year-old passenger stepped in after the vagrant, identified by sources as Jordan Neely, 30, began going on an aggressive rant on a northbound F train Monday afternoon, according to police and a witness who took the video.
“He starts to make a speech,” freelance journalist Juan Alberto Vazquez said in Spanish during an interview Tuesday, referring to the disturbed man.
“He started screaming in an aggressive manner,” Vazquez told The Post. “He said he had no food, he had no drink, that he was tired and doesn’t care if he goes to jail. He started screaming all these things, took off his jacket, a black jacket that he had, and threw it on the ground.”
That’s when he said the straphanger came up behind Neely and took him to the ground in a chokehold — keeping him there for some 15 minutes, Vazquez said.
As other news reports show, Neely wasn’t just screaming and throwing a fit. No, he was physically menacing other subway riders.
And, this wasn’t the first time either. Neely has a major history of not only menacing people, but physically attacking them.
In 2021, Neely attacked an elderly woman as she left the Bowery station in the East Village. She suffered a broken nose, a fractured orbital bone, and ‘bruising, swelling and substantial pain to the back of her head’ in the November 12 attack, according to a criminal complaint.
Yet that case and the others were dismissed in February due to a plea deal. So Neely, who has a record of over 42 arrests, was dealing with zero consequences for his actions and was left free to roam. Is anyone surprised that there wasn’t any consequences? It’s New York, so it’s essentially par for the course.
Of course, Democrats have jumped all over this case. AOC in particular.
It is appalling how so many take advantage of headlines re: crime for an obsolete “tough on crime” political, media, & budgetary gain, but when a public murder happens that reinforces existing power structures, those same forces rush to exonerate&look the other way. We shouldn’t.

What none of them are showing is any concern for the safety of New York citizens. As we’ve noted here several times, New York along with other Democrat-led cities is now in the business of coddling criminals.
Furthermore, the question must be asked. Where was his family? AOC claims Neely was “houseless” which is evidently the new nicer moniker for homeless. Yet Neely’s family has been all over the news yelling about getting justice for Jordan.
‘Daniel Penny’s press release is not an apology nor an expression of regret,’ they said. ‘It is a character assassination and a clear example of why he believes he was entitled to take Jordan’s life.’
‘He knew nothing about Jordan’s history when he intentionally wrapped his arms around Jordan’s neck, and squeezed and kept squeezing. His actions on the train and now his words show why he needs to be in prison.’
Again, the question remains. Where has his family been all these years?
Well, that doesn’t matter. Only the narrative does.

It’s interesting that Bragg is making this move now. Particularly since Bragg already tried to go after the Jose Alba, the bodega employee and Moussa Diarra for defending themselves, yet after reality hit with the hue and cry, both cases were dropped.
Politics are definitely at play here. How DARE anyone defend themselves from those poor homeless unhoused houseless individuals who physically accost and/or attack others??!!
Alvin Bragg bringing charges of second-degree manslaughter in the Jordan Neely case is a purely political move at this juncture.
According to some, it was fear of black people that motivated Daniel Penny to put Jordan Neely in a choke hold. Oh? Oh really? What if it truly was just one guy trying to stop another from harming others?

Congresswoman Donkey Chompers’s statements on Twitter should be used by Mr. Penny’s attorney as evidence that his client cannot get a fair trail in that city.
And I disagree: This is not politics. This is race based. Whitey needs to be punished for getting uppity and stopping a black man from running rampant.
AOC is obviously in favour of vigilante justice being administered by her and her cronies. Clearly, she believes in hanging first and holding the trial later.
She and her kind will miss civilization when it’s gone.
