Hallelujah and Huzzah! Justice can still be found in New York City. Daniel Penny, an inactive U.S. Marine, architecture student and subway rider, was found not guilty of criminally negligent homicide by a jury today. This verdict was reached after the Prosecution requested the judge dismiss the primary charge of manslaughter when the jury deadlocked on a verdict. This is a great day for the United States, New York City, the U.S. Marines and Justice itself.
Well for the sane among us this is a great day. From MSN:
Daniel Penny was acquitted in the 2023 death of Jordan Neely, which prosecutors argued at trial was the result of Penny going too far in restraining Neely on a New York City subway. The verdict followed Friday’s dismissal of a more serious manslaughter charge, which jurors said they couldn’t agree on and prosecutors moved to dismiss so the jury could consider the lesser charge.
Penny’s lawyers wanted a mistrial on Friday instead of dismissing the top count, but this result leaves him clear of all charges after the jury found the prosecution failed to prove beyond a reasonable doubt that he was guilty of criminally negligent homicide.
Penny had pleaded not guilty in the case that spotlighted issues of race, public safety, mental health and vigilantism in the city. The manslaughter count alleged that Penny, a white Marine veteran in his mid-20s, recklessly caused the death of Neely, a 30-year-old homeless Black man, while the second charge alleged Penny caused Neely’s death with criminal negligence.
Daniel Penny deserves a Presidential Medal of Freedom, the Key to New York City and his college tuition paid if his G.I. Benefits don’t completely cover the cost. Jeez Louise. The reason issues of race, public safety, mental health and vigilantism were spotlighted were spotlighted was because it suited the agendas of the America-hating Media Industrial Complex.
Most importantly, the agenda of the execrable Alvin Bragg. The District Attorney who turned a normal business transaction into 34 counts against Donald Trump. The incompetent who didn’t hold the criminal illegal aliens who attacked law enforcement officers. He surely is mighty miffed about Daniel Penny being acquitted. Alan Dershowitz thinks Bragg should be removed from office.
There is an idea we can get behind. We can especially get behind it when we read Bragg’s whining statement.

Bragg then claimed that throughout the trial, his deputy DAs were “besieged with hate and threats” on social media, over the phone, and via email.
“Simply put, this is unacceptable, and everyone, no matter your opinion on this case, should condemn it,” Bragg said. “These are prosecutors who have dedicated decades of their lives to public service and to the safety of Manhattan.”
Meanwhile, the anti-Penny protests were audible from inside the courtroom, chanting “If we don’t get no justice, they don’t get no peace.” The defense raised the issue of the audible chants, saying such could be seen as threats against the jury. In response, the prosecution claimed that “there are numerous threats from the other side going on constantly.”
Judge Maxwell Wiley, who presided over the proceedings, agreed with the prosecution that there’s been “shade thrown at the DA’s office” and “particularly the ADA’s handling of this case” “which I think is unfair.”
The judge drew the line at anyone suggesting that Bragg was behind any of it. “Let’s not even go there,” he said.
Oh no. We wouldn’t want to think that Bragg colluded with Black Lives Matters (wink, wink). Hawk Newsome, head of BLM NYC held forth outside court on Friday:
Hawk Newsome, co-founder of New York’s BLM chapter, told reporters outside court on Friday, “Racism is still alive and kicking in America…those among you who say that Daniel Penny is innocent, have racism and bias in your heart.”
“Today, white supremacy got another victory. Today, the KKK [Ku Klux Klan], the klansmen, the evil in America got another victory,” Newsome said, adding, that the nation will “continue to place second-class status on Black people.”
Newsome also accused Penny’s lawyers of picking a white supremacist jury specialist “to target the racists in that jury. The prosecution pointed out the fact that defense was eliminating people based on race.”
Here is the charming Mr. Newsome back in May calling a Law Enforcement Officer a vagina.

The biggest racism came from the Assistant District Attorney, according to Townhall:
Assistant district attorney Jillian Shartrand repeatedly referred to Penny as “the white man” in front of the jury in an apparent effort to racially charge the case. At the outset of trial, the prosecution tried to control what witnesses could say about Penny, particularly how they were allowed to characterize him in court. Assistant DA Dafna Yoran said witnesses shouldn’t be permitted to praise Penny as a “hero” or “good Samaritan.”
Jordan Neely’s father is currently suing Daniel Penny for wrongful death. It should be the other way around.
