Judge Boasberg Blocks Tren de Arugua Deportations Again

Judge James Boasberg evidently spent the entire weekend writing up his 37-page order that once again blocks Tren de Arugua deportations from happening. He cites due process as one of the key reasons for blocking the Trump Administration’s motion.

In a 37-page order, the judge, James E. Boasberg, said the order should remain in place so that the Venezuelan immigrants could have the opportunity to challenge accusations that they belong to the gang, Tren de Aragua, before the Trump administration can fly them out of the country under the wartime law known as the Alien Enemies Act.

The Alien Enemies Act, Judge Boasberg wrote, “arguably envisions that those caught up in its web must be given the opportunity to seek such review.”

Judge Boasberg, who serves as the chief judge of the Federal District Court in Washington, issued an initial order on March 15 temporarily barring the administration from using the act to deport scores of Venezuelans to a prison in El Salvador with little or no due process.

Of course, the media has been all over this issue, and carrying sympathetic water for all the poor misguided illegal aliens who’ve been summarily yanked from their new American homes and jobs and shuttled off to the worlds worst prison EVAH in El Salvador. 

For example, one is wrongly sent to El Salvador’s prison because he got the wrong tattoo. Yes, really.

Judge Joseph Imburgia again scanned the courtroom buried deep within a sprawling U.S. Immigration and Customs Enforcement detention facility in suburban Denver, looking over the rows of men in orange or red detainee clothing. Venezuelan migrant Jefferson José Laya Freites, 33, was due in court for a pending asylum-and-detention hearing.

He wasn’t there.

Stepping forward, an attorney with an immigrant rights group told Imburgia that Laya Freites’ wife believed he’d been transferred to Texas following a Denver-area traffic stop, and then shipped to a notorious Salvadoran prison. Trump officials recently signed a $6 million detention deal with El Salvador to hold U.S. detainees.

“She saw her husband on video at the Salvadoran prison,” attorney Monique Sherman told Imburgia.

So, that guy just innocently picked out a known gang tattoo for his new skin art? Uh huh, pull the other leg. Secondly, the wife saw her husband on video at the prison? Really?

Evidently, Judge Boasberg, with this new ruling, has been listening and reading the breathlessly sympathetic media reports. And, is also hoping that more Tren de Arugua gang members along with members of other cartel gangs won’t be deported before they too can have their day in court … likely in front of sympathetic judges. 

Is he going to try to block these three well-known criminals from being deported BACK to Chile at Chile’s request?? 

The department said three known TdA members named Adrian Rafael Gamez Finol, Miguel Oyola Jimenez and Edgar Javier Benitez Rubio “illegally entered the United States after allegedy committing horrific crimes in Chile.” DOJ declared all three to be “Alien Enemies.”

“Recognizing the grave threat that TdA poses to the nations it infiltrates, Chile has asked the United States to help return these men to Chile to face justice,” the department said. “Today, the Department of Justice announced that it will take swift action to grant these requests and send these Alien Enemies to Chile.”

DOJ said the men are wanted in Chile for extortion, kidnapping resulting in homicide, unjustified firearm discharge, kidnapping for ransom, among other charges.

It would not surprise me one bit if he, during this afternoon’s appeal hearing, tries to expand his ruling to cover such instances as blocking ANOTHER country’s request for deportation of criminals, so they can stand trial there. 

It seems it doesn’t matter to Boasberg that the majority if not all of those who were deported had actually committed real crimes here in the U.S. against American citizens. 

For too long, we’ve bent over backwards to “be nice” to the criminals who commit crimes against Americans instead of enacting real consequences for their actions. If we had done so, how many young women, girls, grandmothers, and many other victims would be alive or not have to go the rest of their days dealing with the trauma of what happened to them? 

Here’s another question regarding Boasberg. 

In my opinion, Judge Boasberg’s order to continue to block deportations of Tren de Aragua and other criminals here illegally, puts him in the same camp as Boston’s Mayor Wu. These, per local CBS news, are the criminals she’s harboring instead of turning over to ICE for deportation. 

Take Jose Fernando-Perez, who was arrested by ICE in Framingham in February. According to an ICE press release, the Essex County Superior Court in Salem arraigned him on three counts of rape of a child by force and three counts of aggravated rape of a child in August, 2022. WBZ called the court and found that he posted a $7500 bail and was released with an order to stay in his home in October, 2022.

Stivenson Omar Perez-Ajtzalan was arraigned in Lawrence District Court arraigned Perez Dec. 20, 2024, on felony charges of aggravated rape of a child with a ten-year age difference, according to an ICE press release. WBZ learned that he posted his $7500 bail and was released with a GPS monitoring device. He was arrested by ICE in January.

That’s just TWO of the many in Boston. It is those criminals whom Boasberg is attempting to “protect” from deportation so that they too can have their day in court.

    Just heard a report about this leftist attending a ” Hate Trump” conference last summer, with speakers.advising on how to interfere with his agenda.. sounds like a serious conflict to me.
