Bergdahl Conviction Vacated, Still A Traitor

In what seemed like a bombshell yesterday afternoon, came the news of a federal judge vacating the conviction and sentence of Bowe Bergdahl.

According to this, Reggie B Walton of the Federal District Court of the District of Columbia ruled that a “military judge presiding over Bergdahl’s 2017 punishment process gave the potential appearance of a conflict of interest by failing to disclose that he applied for a job in the Trump administration during the former soldier’s legal proceedings.”

Trump did not mince words about Bowe Bergdahl, calling his sentencing a “complete disgrace“. I mean, he wasn’t wrong.

The dude walked off his post in a war zone. HE wandered off. His irresponsibility put others in danger. And, he was a pawn in the Obama Administration’s attempt to rid Guantanamo Bay of its prisoners. While other soldiers put themselves in harms way looking for Bergdahl, Obama was making trades with the Taliban. Those five prisoners traded for one (useless) Bowe Bergdahl were released from GITMO to, no doubt, go back to their business of the Taliban. Say…where are we now in Afghanistan? Right. We’re nowhere to be found!

Without referring to John McCain or Donald Trump by name (though we knew who he was referring to), Judge Reggie B. Walton expressed his issue with “political officials who express their desired verdict and punishment of individuals merely accused of committing criminal offenses.” He said that this would subject our justice system to “widespread condemnation by the public it serves”.

Merely accused? Bowe didn’t just wander off to party with the Haqqani Network for the night. He wandered off for FIVE YEARS! And, excuse me? Convicting and sentencing a military deserter who camped out with the enemy for FIVE YEARS would not bring on any condemnation to a “justice” system that lets him off with a mere slap on the wrist and demotion in rank? Come on! Reggie, you have not yet begun to see the condemnation!

Walton also said that this standard also should apply to the military justice system. I mean, after all, we don’t want to be those kind of people who actually impose consequences on individuals who promised to serve our country after they walk off and never report back for duty. Those DEI classes the Army is offering up are game changers. After all, Bowe Bergdahl wasn’t just any old Army Sergeant. He was a fragile young man.

I’m worried. The closer I get to ship day, the calmer the voices are. I’m reverting. I’m getting colder. My feelings are being flushed with the frozen logic and the training, all the unfeeling cold judgment of the darkness.”-Bowe Bergdahl

Tortured soul. So worried, he wandered right into a Taliban cage and remained there for five years.

But as we read on, we wonder of this vacated conviction had more to do with someone else besides Mr. Bergdahl:

The ruling is not the first time Walton, a 2001 George W. Bush appointee to the federal bench, has criticized Trump. After a trial involving a Jan. 6, 2021, Capitol riot defendant last year, Walton described Trump as a ‘charlatan who doesn’t, in my view, really care about democracy but only about power. And as a result of that, it’s tearing this country apart.’”-Spencer S. Hsu and Alex Horton, The Washington Post

Yes, Captain Obvious, Walton despises Trump. What better way to put the screws to the big, bad Orange Man. Unfortunately, Bowe Bergdahl screwed his soldiers in battle and the army as a whole…but no one from The New York Times or The Washington Post mentions that.

I think I just barfed in my mouth a bit. Amazing win? Wrongful conviction? How was Bowe Bergdahl “wrongfully convicted”? Last I checked, didn’t he plead guilty?

But, according to Rachel E. VanNutcase Lawyer, queen of military justice reform, this is cause for celebration.

And justice is a big laugh, here, I tell you. Let’s try and give that “justice” spiel to the families of the six soldiers who died looking for Bowe Bergdahl after he went missing. Where is their justice? Chief Petty Officer James Hatch and his family. Hatch was shot in the leg and had to undergo 18 surgeries because he was one of the many who went out looking for Bergdahl.

Bowe Bergdahl vacated his post and now, a judge vacates Bergdahl’s sentence and conviction. Looks like sanity and justice have both vacated the building. The only constant that remains here is Bergdahl is still a feckless traitor.

    So let me make sure I understand this. The military judge erred by not disclosing that he (?) had applied for a job in the Trump administration, but a political hack like Walton feels free to trash the former president (who wasn’t on trial in Walton’s court) and then toss aside the connection of a traitor like Bergdahl because of a tangential relationship to the hated Trump.

    Walton must be seeking to replace Emmet Sullivan as the most incompetent judge in the DC federal district court.

    The DC federal district court should be abolished.

      No one who lives or works in DC should have jurisdiction over DC (except the Constitutionally mandated Congressional jurisdiction). (I don’t think Congresscritters should be allowed to live in DC, either – except in barracks or some such.)

    And who is Judge Walton? He ran the United States Foreign Intelligence Surveillance Court from 2013 until… I can’t figure out when based on his biography. He also presided over the trial of Scooter Libby.

    So, despite being appointed to this position by Bush 43, he has a couple of problematic assignments.

    Aside from any prestigious or notorious background, though, this is idiotic, given how everyone in the Executive branch resisted Trump in everything he did, but somehow this was “undue command influence.” Sorry, bullshit.

    Wait, what? Was he involved in the trial? Because, if so, he just indicted himself on the exact same point as he just vacated Bergdahl’s sentence.

    Oh, no, your bullshit is precisely why the military IS handled by a separate court. You’d be trying them for murder for assaulting an enemy position. And nice try to throw the “racism” card in there, white girl.
    If you want to talk about harming the reputation of … everything, just look to people like this. Their lies and filth have dragged this country down into the ditch. We should [censored] and leave them there.

    On top of everything else “undue command influence” is a VERY hard charge to prove. And Walton just pitched it out like it was jaywalking.

    Having said all that, this is one of those times Trump’s mouth shot him in the foot. I said at the time he should just keep his mouth shut about it. SMH

    I can’t in good conscience recommend anyone join the military any longer. Not even the GI Bill is worth this kind of garbage.
