Volleyball Players Sue Mountain West Conference Over Title IX Violations

The Mountain West Conference has a Title IX and transgender policy problem. This new lawsuit from multiple volleyball players across the conference makes that very clear.

The Independent Council on Women’s Sports (ICONS) has announced its support for a lawsuit filed by a group of female athletes against the Mountain West Conference (MWC) and San Jose State University (SJSU).

The lawsuit challenges the inclusion of a transgender male athlete on the women’s volleyball team, arguing it compromises the fairness and safety of female athletes.

The lawsuit, filed by San Jose State volleyball captain Brooke Slusser and other female athletes, alleges that the MWC and SJSU have violated Title IX and other relevant laws by allowing the transgender athlete to compete on the women’s team.

As the lawsuit points out, there was some stealth rule-making by the Mountain West Conference commissioner and board of trustees in September. 

On Sept. 27, just as the second of those four schools was canceling, the Mountain West Conference authored a rule saying those cancellations would count as losses, according to the lawsuit.

The complaint alleges that Mountain West leaders “hastily” drafted a new rule, making the canceling teams chalk up a forfeiture loss for each cancellation.

As the lawsuit alleges, metadata shows this new “rule” was drafted at the end of September. But the email ABOUT that rule states it was adopted in August of ….2022. Yet the metadata shows the rule was drafted in September 2024, and also contains language that is essentially a “don’t ask, don’t tell” rule. Which means that no disclosure is necessary from one team to another (and possibly within the team itself) that there’s a transgender player on board.

This is certainly an interesting twist that looks to be very problematic for the Mountain West conference. 

That said, there are other details in this lawsuit that are troubling for the Commissioner, board of trustees, and San Jose head coach Todd Kress. In which Kress dismissed the idea that Fleming and two other SJSU players colluded with at least one, if not two Colorado State players to throw the match on October 3 AND specifically target Brooke Slusser during that match. 

“After the SJSU Team got back to campus, student-athlete Chandler Manusky told teammates, including co-captains Alyssa Bjork and Brooke Bryant, that Manusky, Fleming, and [Randilyn] Reeves, had snuck out of the team hotel after hours the night before the [match],” the suit reads.

Manusky later spoke to SJSU coaches about the incident after Bjork and Bryant implored her to do so.

According to Manusky’s recounting, “They had discussed Fleming ‘throw[ing] the game’ and how they would set up Jones to ‘blow up’ Slusser and ‘blast’ her in the face during the game.”

According to the lawsuit, what did Coach Kress do after learning that the players violated school policy by leaving? Nothing given he’s on record as not believing Manusky’s report. Furthermore, Kress also made a highly problematic move by allowing Fleming and Reeves to stay in Colorado rather than travel back to SJSU with the team. 

It’s also looking highly likely that there was not an investigation of any kind into Fleming’s plan to throw the match and have players specifically target Brook Slusser. Both SJSU AND CSU need to answer why that didn’t happen. 

Furthermore, as we’ve pointed out time and again, as have many others, male athletes are genetically and biologically stronger than women. Which means, if there’s a man on a women’s team, the other women are at risk. 

The plaintiffs argue that this policy creates an unfair playing field and poses a risk to the safety of female athletes.

“Women must speak up now,” Slusser said. “This lawsuit sends a clear message: universities will face consequences for placing female athletes in harmful and unlawful situations. We won’t ignore the differences between males and females, and we won’t be silenced. I’m grateful to take this fight to court.”

Evidently the National WOMEN’S Law Center is in favor of letting Fleming or any other male play on women’s sports teams. 

“Title IX does not say anywhere that you can’t play with trans women,” said National Women’s Law Center senior director Shiwali Patel. “It’s misleading, it’s a threat, it’s based on what they’re trying to achieve by banning transgender women from women’s sports.”

The ICONS letter “urgently demands,” that Mountain West schools “act immediately and decisively to protect and support your women volleyball players and their rights to equal athletic opportunities and fair and safe competition which are guaranteed by Title IX and the Equal Protection Clause of the Fourteenth Amendment.”

What a crock. A man can say he’s a woman all he wants, and destroy his body with drugs and surgeries. Yet, at the end of the day, he will still be A MAN.

Furthermore, it’s absolutely amazing to me that so many who’ve fought for women’s rights and equality are willing to throw all of that aside to cater to the transgender crowd. 

That’s an accurate look as to how the insanity of the transgender craze is harming women and women’s sports. 

The Mountain West Conference has a problem. And it’s not the women, it’s the men.

    The people running our universities need to be replaced.

    Government has corrupted our universities by throwing so much money at them. Contemplate the fact that almost all of the Ivy League schools use to be seminaries. Now they are practically atheistic. Why? Science and Christianity are incompatible? That is what they might say, but it abominably ignorant.

    Frankly, anyone who looks at the science knows that allowing men into women’s sports is an absurd idea. Moreover, when Congress designed legislation to promote women’s sports, they would have been appalled if they knew that legislation would be used as an excuse to put men pretending to be women into women’s sports.

    Given the election of President Donald Trump, I think this transgender nonsense will be roll back. So, ladies, please stand your ground and be patient.

    If the label says ‘trans woman’ then it is not a ‘woman’. That’s implicit, but the Left love to twist language in their hypocrisy.

    Imagine you have a young daughter that from the age of four, dedicated her time and skills to become a premier volleyball player. Early morning hours before school, afternoons and evenings spent in the gym improving skills and technique. Working hard and suffering through injuries for 14 years. Applying for scholarships at various schools, only to be told she isn’t good enough because one of those scholarships she wanted was taken by a transgendered man! This guy is four inches taller and 25 pounds heavier. And he went through puberty where his male physique matured. More muscle mass, larger bones, of course he’s better at volleyball. And your daughter’s life long dream and work ethic doesn’t matter because some guy who isn’t good enough to make the men’s team decides he can still get a free ride at college because two years ago he decided to take puberty blockers.

    Men playing against women in “Women’s Sports” is wrong! If those that are in power want to make things equitable, they would create a third classification in sports. One for trans athletes. It is anti-woman and highly sexist to allow biological males to play against biological females and say it’s only “equitable” to do so!

      In volleyball the height of the net is different for women from men. For men it is 7 feet 11 5/8 inches. For women it is 7 feet 4 1/8 inches. Thus a physically mature athletic man has an even greater advantage in spiking – hard.

    No, “A male can say he’s a woman all he wants, and destroy his body with drugs and surgeries. Yet, at the end of the day, he will still be A MALE.” Brayden Fleming is definitely a male, but he is not, and never was, actually a man.

    Slusser made headlines after she joined a lawsuit against the NCAA alleging that San Jose State had not warned any of its recruits that it had a transgender athlete on the team. Slusser says she played two full seasons with Fleming, sharing a locker room and rooms on overnight trips without being told that Fleming was a biological male.

    Either Mr Fleming has already had some form of ‘sexual reassignment surgery,’ or he had been very good at keeping himself concealed in locker and hotel rooms.

    Miss Slusser’s statement does raise a conflict of privacy issues. The school could not legally tell potential recruits that he is male without his consent, but it also constitutes fraud on the part of the university not to tell recruits about his status; some recruits might have taken different decisions on signing with the school if they had been made aware of Mr Fleming’s status.
