Distaff Side Of The Supreme Court Shafts Us Again

The Supreme Court found five to four in a decision that said President Donald Trump could use the Alien Enemies Act of 1798 to deport Tren de Aragua and MS-13 gang members and other miscreants, but that they must get some due process. The filings in Washington D.C. were wrong. The case must be filed in Texas. The distaff side of the Supreme Court, led by Sonia Sotomayor, sees this as a threat to the rule of law. Hmmm? Like importing gang members en masse is super great to the rule of law. We would ask the victims how they feel about Sotomayor’s rule of law but they are DEAD.

Yes, the Biden Puppeteer and Alejandro Mayorkas started this, but we are looking at the pissant District Judge Boasberg who loves him some Tren De Aragua. A District Judge has more sweeping powers than the President of the United States? Boasberg spent his weekend last month having his clerks draw up his 37 page order. Not to be outdone, the distaff coven of the Supreme Court selected Sonia Sotomayor to fashion their angry dissent.

The five justice majority did not sign their opinion and did not rule on the detainees already sent off to prison. The majority did say that the 200 held in Texas must be given their day in court before they are sent to the El Salvadoran prison. From the L.A. Times:

“The detainees’ rights against summary removal are not currently in dispute,” the court said. The “detainees must receive notice after the notice of this order that they are subject to removal. … The notice must be afforded within a reasonable time and in such a manner as will allow them to actually seek habeas relief in the proper venue before such removal occurs.”

This was the Trump administration’s fallback position.

It had said initially that these detained men had no rights to appeal because the president had the wartime power under the Alien Enemies Act of 1798 to deport “hostile” aliens.

In Texas, witches. Where they are currently held! The court hearings are lame, but this is so beautiful.

Sonia Sotomayor had a mad pout when she wrote the distaff dissent. From the L.A. Times again:

In dissent were Justices Sonia Sotomayor, Elena Kagan, Ketanji Brown Jackson and Amy Coney Barrett.

“The Government’s conduct in this litigation poses an extraordinary threat to the rule of law,” Sotomayor wrote in dissent. “That a majority of this Court now rewards the government for its behavior with discretionary equitable relief is indefensible. We, as a Nation and a court of law, should be better than this.”

Oh my effing gravy! No, we are not better than this. When someone is an invader, who murders and rapes, cuts off fingers and steals property, no. I remember MS-13 hacking girls to death on Long Island when I lived in Connecticut. Some of these cretins are just being adjudicated. The law cannot be completely academic. As times, it must live in reality. Some more derpage from Sotomayor:

Wrong again. Has Sotomayor ever understood the facts in a case? Kilmar Abrego Garcia entered the U.S. illegally. Here is more from The Times of India:

No. Abrego Garcia was a Salvadoran national, not a citizen of the United States. He entered the US around 2011 after fleeing gang violence as a teenager and lived in Maryland with his wife and young US-born son. Although married to an American and living legally in the country, he never became a naturalized citizen.

His legal presence in the US was based on a protection known as “withholding of removal,” which was granted by an immigration judge in 2019. That status is awarded when a judge determines that deporting someone would expose them to persecution or torture in their home country. In Abrego Garcia’s case, the judge ruled he faced credible threats of violence if returned to El Salvador — particularly from the very gangs he was accused of belonging to.

In fourteen years he never thought to get right with the law? Interesting. I would have tried to become a citizen to protect my wife and son, but not Kilmar Armando Abrego-Garcia.

Ketanji Brown-Jackson, who cannot define a woman, dropped some Lemons of Idiocy, from the L.A. Times:

Jackson said she questioned the “majority’s choice to intervene on the eve of the District Court’s preliminary-injunction hearing without scheduling argument or receiving merits briefing. This fly-by-night approach to the work of the Supreme Court is not only misguided. It is also dangerous.”

She referred to Judge James Boasberg, who was considering issuing a preliminary injunction to block further deportations.

Under U.S. immigration law, the government may deport migrants with a criminal record.

But Trump and advisers decided to bypass that legal system and instead order the swift and nearly secret deportation of hundreds of Venezuelans who had tattoos that suggested they were members of a criminal gang.

They claimed a wartime power for the president by invoking the Alien Enemies Act of 1798, adopted when President John Adams feared a war with France, which had been seizing American ships.

“Fly by night.” What bird shite covered rock does Brown-Jackson live under? This is the fourth time this act has been used. World War II was the last time, only 80 years ago. This is reasonable when Venezuela emptied out their prisons and sent the worst here.

Finally, Amy Coney Barrett. What a waste. Does she have “suicidal empathy”?

Coney Barrett dissented about Parts II and III, which is mostly arcana:

I am about to give up on our country. Maybe men do make better women than women. My sad face.

Barrett is a complete disappointment.. I can’t believe the left fought so hard to keep her off the court, she’s becoming almost as reliably anti- American as Roberts..
