Campaign Law Violation: D’Souza Receives Probation, 8 Months in “Community Confinement Center”

Dinesh D’Souza, whose film 2016: Obama’s America accurately predicted the state of the nation and the world under Barack Obama if given a second term, and apparently caught the attention of the administration, was sentenced this morning in his campaign finance law violation case. Mr. D’Souza, who plead guilty in May, was given five years of probation with community service, managing to avoid the 10-16 month prison term demanded by the Feds. But the kicker is that he’s required to spend the first eight months of his probation at a “community confinement center” in San Diego, California. He was also fined $30,000 and directed by Judge Richard Berman to undergo “therapeutic counseling.”

In a sentencing submission, D’Souza’s lawyer, Benjamin Brafman, asked Berman to sentence his client, a first-time offender, to a probation term that would include a community service component. Brafman contended that D’Souza was singled out for prosecution by the Department of Justice due to his “consistently caustic and highly publicized criticism” of President Barack Obama.

In his own letter to Berman, D’Souza contended that, “No good purpose would be served by locking me up.”

In response to D’Souza’s plea for leniency, federal prosecutors asked Berman to sentence to the convicted felon to 10 to 16 months in prison. “The defendant’s crime is serious and strikes at the heart of our federal election system,” prosecutors argued.

Leading up to Mr. D’Souza’s sentencing this morning, it was revealed that Eric Holder’s DOJ mislead the court, presenting it with distorted facts from similar cases in order to seek prison time for Mr. D’Souza. I know, pull your chin up off the floor.

“In a reply sentencing memo submitted to the Court on behalf of D’Souza last week, his counsel argues federal prosecutors excluded and misrepresented the facts of “similar” cases in the Government’s sentencing proposal to Judge Berman, leaving out crucial facts key to fair and equal sentencing for D’Souza compared to other cases. The prosecution has a duty to present comparable cases and crimes when arguing for a prison sentence. In their presentation of “similar” cases to the Judge for consideration during his deliberation, the prosecution ignored all truly similar cases without prison time but did present cases that included prison time without a full set of facts to justify sentencing.

Seems to me, if we’re to mete out our justice blindly, than the one who ought to be punished to the full extent of the law is Eric “Selective Prosecution” Holder himself, for a litany of offenses. But maybe that’s just me.

    Ironic that federal prosecutors dropped charges against the Black Panthers who physically intimidated voters with weapons at a polling place during the 2004 federal election.

    Is there any explanation for that? That’s is weird. I have never heard anything like that for what … campaign finance law violation? A political “crime?” I am a licensed mental health professional and since when is counseling court ordered for a political and/or white collar “victimless” crime?

    The only “crime” he committed was a “thought” crime. Positively Orwellian. Let’s only hope they don’t “re-educate” him during his public service. Mr. D’Souza, please stand strong. We’re with you out here.
