DOJ To Appeal Dismissal Of Criminal Case Against Killmar Abrego Garcia

In a crazy turn of events yesterday afternoon, a liberal federal judge threw out a two-count indictment in Tennessee against Kilmar Abrego Garcia, ruling the actions of the `DOJ amounted to “vindictive and selective prosecution” in violation of the Fifth Amendment’s Due Process Clause.

The judge? Of course-Obama appointee, Waverly D. Crenshaw Jr.

He didn’t engage in human trafficking, you see. He was “mistakenly deported”. Kilmar Abrego Garcia, the TikTok star. The New York Times calls Crenshaw’s ruling an “embarrassing blow to the Trump administration”.

Mr. Abrego Garcia, who is still fighting the administration’s efforts to expel him from the country, is perhaps the best-known symbol of Mr. Trump’s aggressive deportation agenda. His serial legal battles against the administration have dragged on for more than a year, reaching all the way to the Supreme Court. His release from criminal charges because of what Judge Crenshaw called their ‘vindictive taint’ was another blow to the president’s immigration crackdown, which had already been battered by, among other things, the killings of two protesters in Minnesota by federal agents.”-Alan Feuer, The New York Times

A vindictive taint against an MS-13 gang-member. The only “taint” here is Abrego Garcia himself on our society.

Waverly D. Crenshaw Jr. had mercy on the Maryland father who threatened his wife and locked his kids in a room, once upon a time.

According to the petition filed by Jennifer Vasquez on August 3, 2020, in the District Court of Maryland for Prince George’s County, Garcia verbally abused her, kicked her, slapped her, shoved her, mentally abused her kids, locking them in their bedroom while they cried, and detained Vasquez against her will. In November 2019, Vasquez alleges that Garcia grabbed her by the hair while in a vehicle. In December 2019, she states Garcia grabbed her from her hair in the car and dragged her out of the vehicle–abandoning her in the street. In January 2020, Vasquez claims Garcia broke her son’s tablet and broke doors in their house. In March 2020, she alleges that Garcia pushed her against the wall while breaking phones and TVs.”-DHS.gov

Husband. Father. Just trying to get a piece of the American Dream, say all of the Democrats. According to Crenshaw, Abrego Garcia was just a victim that was “picked” by the prosecution, instead of the crime and the case, being picked by the prosecution.

This was not a “misunderstanding” or a “vindictive plot” to ruin this “chequeo”, gangbanger-oops-I mean- this “husband” and “father”‘s life. Kilmar Abrego Garcia was in this country illegally, was deported and re-entered this country, again,-illegally. He smuggled in abused women under his control, smuggled in children and solicited child porn on behalf of MS-13. Judge Crenshaw is acting as if the American justice system wronged him. A non-citizen.

Wishful thinking. Bye. Don’t let the door hit your a$$ on the way out. Not likely to happen, though.

Abrego Garcia did express his gratitude to Judge Crenshaw.

Justice is a big word and an even bigger promise to fulfill,” he said. “And I am grateful that today, justice has taken a step forward.”-Kilmar Abrego Garcia

Trafficking is a bigger word, Kilmar.

Today, a federal judge made clear what we have long known: the Department of Justice was engaged in a vindictive prosecution against Kilmar Abrego Garcia. As the judge stated, this was a blatant ‘abuse of prosecutorial power’ – one that should disturb all Americans. This decision is a strong repudiation of Trump’s lawless DOJ and a win for the Constitutional rights of everyone in our nation.”-

Nothing’s “lawless” about trafficking abused women. Nothing’s “lawless” about inflicting violence on the person you married or your own children. Nothing is “lawless” about soliciting child pornography, either. All of these legitimate acts of a fine, upstanding “Maryland father” who lawlessly hopped our border walls.

There is still hope. Natalie Baldassarre, a DOJ spokeswoman, said that prosecutors would appeal Judge Crenshaw’s ruling. In the meantime, Abrego Garcia is free to move about and do as he pleases. A free man, still here. last we checked,` illegally`.

As far as vindictive goes, they have not seen anything yet. Let him walk free for now. Go ahead and have that celebratory margarita with your buddy Chris Van Hollen, Kilmar. Let’s hope the DOJ says what they mean and means what they say.
