Appeals Court Ruling: Federal Funding For Planned Parenthood Can Be Cut

Planned Parenthood chose the wrong activist judge. The 1st Circuit Court of Appeals just ruled that their federal funding for can be cut.

A U.S. appeals court panel on Thursday allowed President Donald Trump’s administration to block Medicaid funds to Planned Parenthood while legal challenges continue.

A federal judge in July ruled Planned Parenthood clinics nationwide must continue to be reimbursed for Medicaid funding as the nation’s largest abortion provider fights Trump’s administration over efforts to defund the organization in his signature tax legislation.

Medicaid is a government health care program that serves millions of low-income and disabled Americans. Nearly half of Planned Parenthood’s patients rely on Medicaid.

The back story is this. In Trump’s big bill, taxpayer funding for Planned Parenthood was on the chopping block. Well, of course they didn’t like that one bit. And ran to the nearest activist judge they could find. Judge Indira Talwani immediately imposed an injunction staying those funding cuts. Talwani even claimed that this funding cut was against the Constitution! Yes, Talwani claimed that Planned Parenthood had a Constitutional right to our tax dollars. 

Talwani tried to make this a nationwide injunction. And she just got thoroughly smacked down by the 1st Circuit.

What’s interesting about this is something many people miss regarding Planned Parenthood and federal funding in Trump’s bill. 

A three-judge panel on the U.S. Court of Appeals for the First Circuit granted a stay pending appeal of an injunction that had blocked the provision of President Donald Trump’s signature legislation. The three judges, all appointees of former President Joe Biden, did not provide a detailed reasoning for lifting the district court’s injunction.

The provision of the OBBB Act prevents Medicaid reimbursements for healthcare providers that receive more than $800,000 annually in funds from the program and that also provide abortion services. The provision is only set to last one year, but its inclusion was a significant victory for anti-abortion advocates.

That’s correct. The provision in the bill only paused funding for one year. Planned Parenthood knew that and wanted their funding to continue in perpetuity. I’m sure they hoped that Judge Talwani’s injunctions would be upheld by the 1st Circuit because the judges were appointed by Joe Biden. Well, SURPRISE! 

This isn’t the first loss for that organization this year. 

For far too long, Planned Parenthood has enjoyed taxpayer funding whether we the tax payers agreed to it or not. The organization has long claimed that they provide “healthcare” for women in need. They’ve claimed and still do, that abortion IS healthcare. Democrats have long supported the killing of babies. And it’s evident that the abortion ghouls truly thought their funding stream would continue in perpetuity. 

The President of Planned Parenthood issued the following:

“With this decision, patients and providers are in limbo. Patients who rely on the essential health care that Planned Parenthood health centers provide can’t plan for their futures, decide where they go for care, or control their lives, bodies, and futures — all because the Trump administration and its backers want to attack Planned Parenthood and shut down health centers,” Johnson said in a statement.

“This is a blow, but the fight isn’t over. For over 100 years, Planned Parenthood has faced unrelenting attacks, but we’re still here providing care, information, and resources. We will continue to fight this unconstitutional law, even though this court has allowed it to impact patients,” she added.

Abortion is NOT care in anyway shape or form. It is definitively the killing of babies. And despite their claims that they provide full medical care, their own reports say otherwise. Via Townhall:

According to Planned Parenthood’s 2023-2024 annual report, they performed just over 402,000 abortions, roughly 40% of all abortions in the United States. At the same time, those “health centers” McGill Johnson mentioned provided far fewer services, including 2,148 adoption referrals, 7,000 prenatal services, and 3,598 cases of miscarriage care.

They provide a lot of healthcare don’t they? 402,000 babies killed in one year. It’s just flat out evil. 

It wouldn’t surprise me if this was appealed to the full 1st Circuit or even skipped up to SCOTUS. That said. A 3-0 decision bluntly saying NO is a pretty solid indicator that this case is likely dead in its tracks. 

Abortion kills babies. Period. 

It is misguided young kids like that whom Planned Parenthood is targeting and catering too, especially given that too many do not understand that an embryo IS a living being. 

We should not be using our tax dollars to fund Planned Parenthood and abortion. This 1st Circuit decision is yet another step in the right direction. 

Finally, given that the bill was passed and signed into law, this injunction holds that Medicaid can turn the money spigot off immediately.

    Trump merely signed the OBBB Act. Congress is the one who stopped the funding. And it is the branch of government that has the power of the purse. If Congress decides not to fund something, the only redress is to the voters.

    That district court judge is blatantly unqualified, she is ignorant of the Constitution.
