No ICE For Me! Wisconsin Judge Halts Court Proceedings

On the heels of Judge Hannah Dugan’s arrest by ICE for obstruction, a second Wisconsin Judge has jumped on the bandwagon. Judge Monica Isham will refuse to hear cases so she won’t have to deal with THOSE PEOPLE.

Judge Monica Isham made the announcement in an email to judges across the state on Saturday. Her email, titled “Guidance Requested or I Refuse to Hold Court,” made clear she had no intention of working with Immigration and Customs Enforcement (ICE).

“If there is no guidance for us and no support for us, I will refuse to hold court in Branch 2 in Sawyer County. I will not put myself or my staff who may feel compelled to help me or my community in harms way,” Isham wrote.

“I have no intention of allowing anyone to be taken out of my courtroom by ICE and sent to a concentration camp, especially without due process, as BOTH of the constitutions we swore to support require. Should I start raising bail money?” Isham wrote, referring to the Wisconsin state constitution as well.

Well, isn’t she just too darned cute for words??!! Concentration camps? Wow. That tells me which political party she belongs to. 

This is where we are right now. A sitting judge believes that he or she, in this case Hannah Dugan, is very much above all the laws, even federal law. Evidently Monica Isham is of the same belief. Her statement quotes her adherence to both the Wisconsin and U.S. Constitutions. Yet she is blatantly signaling that she will cherry pick which laws she chooses to follow. 

Since President Trump’s first term in office, we’ve seen attorneys and judges across the legal system cherry pick laws in order to go after the President, his family, friends, and others because they politically disagree with him. They’ve taken their oath to uphold the law, ALL the laws, and tossed them into the trash. 

Judge Hannah Dugan was presiding over a case of a man here illegally – twice, who was being charged with multiple counts of domestic violence. Because she didn’t want ICE, who had a legal order, to arrest the guy she took action. She left the victims stranded in court and tried to sneak Eduardo Flores-Ruiz out a non-public side door. 

That’s blatant obstruction. And she was arrested for that. 

Yet, according to Axios, who really clowned themselves at the WHCA Dinner last night, we are all MAGA maximalists because we are cheering Dugan’s arrest.  No, we aren’t. What we ARE pointing out is that judges do NOT get to decide which laws to uphold and which ones they decide to ignore because reasons and politics. 

Friday’s arrest of Milwaukee County judge Hannah Dugan, on charges of obstructing an immigration arrest, is a stunning escalation of President Trump’s battles with political opponents.

Dugan was arrested Friday for allegedly obstructing the arrest of a man who was in the country illegally, but was appearing in her courtroom on different charges. Dugan allegedly told FBI agents they needed to go see the court’s chief judge before ushering the defendant out through a side door.

The defendant was ultimately apprehended after a brief foot chase.

Thus far we have a judge in New Mexico and his wife under arrest for harboring an illegal in their home. A judge out of San Francisco who has informed the Trump Administration that federal funds cannot be withheld from sanctuary cities. One Wisconsin judge under arrest for obstruction regarding an illegal alien. And now a second Wisconsin judge grandstanding about her refusal to hear ANY cases because she might encounter ICE officials. 

Monica Isham bleated about due process. She’s spiking genuine due process for those appearing in her court whether as defendants or victims. All because of the narrative. A narrative that has chosen illegals over American citizens. 

As Legal Insurrection’s Stacey Matthews points out, the Democrats have been all in clutching pearls over Hannah Dugan. All the while hoping that no one reminds them of their “no one is above the law” glee over President Trump’s arrest and court cases. 

Even a Wisconsin State Rep is signaling his resistance. 

It wouldn’t surprise me one bit if Clancy is cheering Monica Isham on as well. Especially given that we now have a THIRD judge has decided to “form a team” to figure out how to respond to the Trump Administration crackdown.

Judges take an oath to uphold the law. ALL laws, whether they personally agree with them or not. If a judge cannot fulfill that duty, then he or she should be removed. Period. Blatantly acting against an Administration whose politics you don’t like is not the role any judge should take. Ever.

Judges have to reinforce respect for the judiciary in their own conduct. That includes showing restraint and respect in relation to the countervailing powers of the Executive Branch. It certainly includes avoiding actions that could be viewed as criminal or unethical in resisting this Administration.

Judge Monica Isham is choosing politics over the law and judicial restraint. And then, the legal world wonders why many have lost confidence in their ability to be impartial.

    Well, that sounds an awful lot like “I resign.” Stop her paycheck, change the locks on her chambers. It’s that easy,

    Then you’re demonstrating intent to aid and abet. Oh, sure, you added “without due process” to the end of that. Except, by definition, if there’s an ICE hold on a criminal, they’ve already had due process, sweetie. As a matter of fact, ANY of them that have already seen an immigration judge have had their due process.
    Oh, and the “concentration camp” thing? It makes you look hysterical. Which would be enough reason to remove you from the bench, for a lack of “good behavior”, IMO.

    No, dingus, she did not. You wouldn’t know fascism if it leapt onto your face and started wriggling. And she WAS obstructing justice – since the law had been followed, and due process already given. Also, do we really need due process to kick them out, since they evaded due process to enter? Shouldn’t the rest of America get due process, too?

    Blatantly acting against an Administration whose politics you don’t like is not the role any judge should take is insurrection.

    An old adage is that if you pass a bunch of laws that no one will obey, pretty soon the people will obey none of the laws. Same goes for “due process.”
