Judge Orders USDA To Break The Law And Fund SNAP Immediately

SNAP must be fully funded by the end of day today according to an order from Judge Jack McConnell.

You see, he has his shorts in a knot over the fact that the USDA isn’t just arbitrarily grabbing funds from anywhere they can to fund SNAP during the Schumer Shutdown. 

A federal judge in Rhode Island ordered the Trump administration to release full funding for November’s food assistance benefits by Friday. It comes after the partial funding disbursed by the Agriculture Department earlier this week had yet to reach those who qualify for the benefits.

“The court was clear that the administration had to either make the full payment by this past Monday, or it must ‘expeditiously resolve the administrative and clerical burdens it described in its papers,’ but under no circumstances shall the partial payments be made later than Wednesday, November 5th, 2025,” Judge Jack McConnell said in his oral ruling Thursday. “The record is clear that the administration did neither.”

Read the above again. Did you catch something? The USDA has already SENT funds to the states. Judge McConnell is ignoring the fact that the states haven’t sent the funds out to beneficiaries. Now why is that? 

Because the states evidently don’t know how to quickly run the calculations to determine the amount of money each person gets. The judge is ignoring those pesky little details and has his knives out for the Trump Administration. He literally claims that the USDA has created this problem!

McConnell said USDA “cannot now cry that it cannot get timely payments to beneficiary for weeks or months because states are not prepared to make partial payments. USDA arbitrarily and capriciously created this problem.”

No Jack. The people who created this problem are the Democrats with Schumer in the lead, who refused to vote to approve a Clean Resolution! 

One thing we’ve discovered during THIS government shutdown is the number of people on SNAP, 42 MILLION!, and the amount of fraud and waste with this program. And we certainly don’t know the depth of it at this point!

I’d say the whole Covid pandemic was A factor, but not the only factor. 

Rep. Pam Altendorf, R-Red Wing, recently took to social media to highlight how Minnesota saw a 174% increase in SNAP issuance between fiscal years 2020 and 2021 — the largest one-year jump of any state in the nation, according to federal data.

Altendorf said the size and speed of the increase should raise alarm.

“When you increase a program expense by more than $1 billion in four years, especially in this state, it just reeks of another potential undiscovered fraud,” she said. “It’s time to investigate why SNAP issuances rose so dramatically and who is receiving these funds.”

It would not surprise me one bit to find out that the massive corruption and fraud from the Feeding Our Future cases have ties to SNAP funding.

Gee, Tim? Care to explain why you don’t want to provide SNAP info to the USDA? 

Here’s the other part of Judge Jack McConnell’s order that is a huge problem. He is essentially ordering the USDA to break the law so that SNAP will be funded! 

In their proposed order, Plaintiffs appear to ask the Court to order USDA to unsuspend allotments and let the system run with full benefits amounts (i.e., deposit full amounts on beneficiaries’ SNAP cards) no matter the absence of funds for such benefits. But that is no option at all. That would be a blatant violation of the Antideficiency Act, a criminal statute that forbids the United States from making such an obligation without an appropriation.

In order to tap into other contingency funds, the USDA must have Congressional approval. That’s damned difficult right now given the fact that the Senate Democrats keep voting NO on a clean resolution and are signaling that they have every intention of letting this mess drag on. 

Judge McConnell evidently doesn’t care that his law fare against the Trump Administration orders the USDA to break the law so that SNAP can be fully funded by the end of today. It’s evident that he’s totally fine with robbing Peter to pay Paul right now. He claims Congress can just fill the gap if or when they finally reopen the government. Uh huh… that’d be a case of robbing Paul to pay Peter back. 

Judge McConnell claims people going hungry because the government isn’t there to feed them isn’t how things are done in America. Tell the Democrats that.

    It used to be that churches and private charities handled this and that it was a mark of shame to use it.
