Judge Aileen Cannon dismissed the Trump Documents case because Special Persecutor Jack Smith was Constitutionally unlawful based on Article II, Section II, Clause II, the appointments clause. Donald Trump is not dead but The Left’s favorite case is. The Left is shook.

Some of us haven’t slept well since the assassination attempt on former President Donald Trump on Saturday (points to self). Events seem to be too big and moving too fast. Sleepy Joe told us about the battle box last night, the Republican National Convention starts this afternoon, and the nasty Trump Documents case has been dismissed. I love winning, but I have whiplash.

The federal judge overseeing the classified documents charges against former president Donald Trump has dismissed the indictment on the grounds that special counsel Jack Smith was improperly appointed, according to a court filing Monday.
U.S. District Judge Aileen M. Cannon’s ruling is a remarkable win for Trump, whose lawyers have attempted long-shot argument after long-shot argument to dismiss the case. Other courts have rejected arguments similar to the one that he made in Florida about the legality of Smith’s appointment.
The Justice Department is highly likely to appeal the decision, a legal fight that could end up at the Supreme Court. By dismissing the entire indictment, Cannon’s decision also means the charges are dropped for Trump’s two co-defendants, Waltine “Walt” Nauta and Carlos De Oliveira.
Basing a long-shot argument on The Constitution, who knew? Religious or not, something has its hand on Donald Trump.

On Monday, the Trump-appointed district judge threw out Trump’s entire classified documents case, seemingly using one concurring opinion from the Supreme Court’s immunity ruling as justification to do so. In her 93-page ruling, Cannon ruled that the appointment of special counsel Jack Smith violated the Constitution—drawing outrage from legal scholars and reporters alike.
