Traitor indicted, but not charged with treason!

An American, from New York, was caught fighting with Al Qaeda in Pakistan. He’s been brought back to the US and arrested. Strangely missing from his indictment? Treason.

A New York man pleaded guilty in January to charges of aiding al Qaeda and helping attack a U.S. military base in Afghanistan, according to court documents unsealed Wednesday.

Bryant Neal Vinas pleaded guilty in to conspiracy to murder U.S. nationals, providing material support to a foreign terrorist organization and receiving military-type training from a foreign terrorist organization, according to Monica McLean, spokeswoman for the FBI’s New York office.

Authorities had accused Vinas of firing rockets at the U.S. military base along with others in September 2008, according to the indictment, filed under seal in January. In addition, authorities said he provided al Qaeda with information about the New York transit system and the Long Island Railroad.

Vinas, 26, is from Long Island, and is an American citizen, said a source close to the investigation. He was arrested in Pakistan, the source said.

Here is the indictment. Basically, he attempted to fire rockets at a US military base in Afghanistan, and then actually did fire rockets at a US military base in Afghanistan. He also provided support to Al Qaeda by providing them with information on the Long Island Railway, where he used to work, paving the way for a potential attack. Lastly, he also received military training from Al Qaeda.

The constitutional definition of treason? From article three, section three:

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

I’m pretty sure that Vinas’ actions should be considered treason. Not ony was he aiding and abetting the enemy, but he actually carried out an attack against the United States. How much more treasonous can one’s actions be? Pamela cites the NY Post, who says that Vinas told investigators about a plot to blow up New York’s subway systems. This information may have prevented another terrorist attack on New York. Is this why he’s been spared a treason charge?
Treason is still punishable by execution. And regardless of this man’s cooperation, he is still a traitor in my book. As if associated with Al Qaeda and being trained by them wasn’t bad enough, he provided them with information to facilitate the planning of another terrorist attack. He attacked US military bases. He is a traitor, and he should be executed. In our new Obambified United States, that won’t happen, but it should.
Hat Tip: The Jawa Report. Head over there to see what Vinas’ political affiliations were (not that I’m surprised).

I’ve read another article that implied that this was some kind of plea deal. It suggested that Vinas had provided good intel to the CIA in exchange for the reduced charges. We’ll see.

Bad as I hate to say it, it would be bad policy to execute someone who traded information for his life. It would tend to have a chilling effect on the next ‘evil doer’ potential stool pigeon. On the bright side, even other convicts don’t like traitors, child molesters, etc.
