A lawsuit filed by a white woman who was artificially impregnated by the sperm of a black man was thrown out of an Illinois court.
In October of 2014, Jennifer Cramblett, part of a same-sex couple, sued Chicago-area Midwest Sperm Bank for ‘wrongful birth and breach of warranty,’ when it was discovered that she had not received the promised sperm of a pre-chosen donor. Cited in the lawsuit were the usual ‘economic and emotional damages.’
A handwritten note had been misread, leading to Cramblett becoming inseminated by the sperm of donor #330 — a black man — rather than the sperm of donor #380, who was preselected three years earlier by Cramblett and her partner Amanda Zinkon. The clinic sent a letter of apology and a refund for the incorrect batch.
Certainly the mistake made was serious, and the plaintiff should be refunded; however, some of the wording from the released court papers reek of racism, as well as the treatment of the now-3-year-old little girl as a commodity and a mistake.
