Judge Rules Khalil Must Be Deported Over Blatant Green Card Fraud

Green card fraud? You don’t say. Will all his Democrat friends run to his defense? An immigration judge ruled yesterday that Mahmoud Khalil must be deported forthwith to Syria or Algeria.

An immigration judge in Louisiana has ordered pro-Palestinian activist Mahmoud Khalil, a legal permanent resident of the U.S., deported to Syria or Algeria for failing to disclose certain information on his green card application, according to documents filed in federal court Wednesday by his lawyers.

Khalil’s lawyers suggested in a filing that they intend to appeal the deportation order, but expressed concern that the appeal process will likely be swift and unfavorable.

The order from the immigration judge, Jamee Comans, came despite a separate order in Khalil’s federal case in New Jersey blocking his deportation while that court considers Khalil’s legal argument that his detention and deportation are unlawful retaliation for his Palestinian advocacy.

You know, I don’t think the 5th Circuit is going to rule in Khalil’s favor. What Politico tap dances around is the green card fraud issue. 

Now, we all know that good ole Khalil overstayed his welcome on his visa so he could participate in protests at Columbia. And is on record a multitude of times advocating not only for Palestine but excusing Hamas terrorism, especially that of October 7, because Trump and the Abraham Accords. Now, I don’t know about you, but sitting on US soil having a glowing interview with Ezra Klein of the New York Times and stating that Hamas HAD to attack on October 7 should mean immediate removal from American soil. 

But no, we’ve been dealing with this for months now while Khalil’s attorneys throw appeals and PR gambits around like confetti. 

But this green card issue SHOULD sink all his boats. You see, he neglected to disclose some very important information on his application. 

“This Court further finds that the Respondent understood the consequences and that the candid disclosure of his affiliations might lead to an additional line of questioning and the ultimate denial of his application for conditional permanent residency. This Court finds that Respondent’s lack of candor on his I-485 was not an oversight by an uninformed, uneducated applicant. This Court finds that the Respondent’s purposeful, non-disclosure was not a misrepresentation by another which imputed consequences to the Respondent,” immigration judge Jamee Comans said in her order.

“Rather, this Court finds that Respondent willfully misrepresented material fact(s) for the sole purpose of circumventing the immigration process and reducing the likelihood his application would be denied,” Comans said. “This Court cannot and will not condone such an action by granting a discretionary waiver. To do so, would encourage future applicants to take the gamble of materially misrepresenting facts and then seeking a waiver if it is somehow discovered by the U.S. government.“

Judge Comans isn’t playing around here. Her ruling is quite something. Judge Comans points directly to several 5th Circuit rulings in regards to similar cases. Furthermore, she then points to the fact that Khalil has made no effort to gain employment prior to earlier this year when all this mess began at Columbia, and that his presence here in the U.S. was ALWAYS conditional!

This part of her ruling is the kicker. 

The Court also takes into consideration, as a negative factor, the Respondent’s underlying fraud in the course of applying for adjustment of status. The Respondent failed to disclose his involvement, association and participation with United Nations Relief and Works Agency for Palestinian Refugees (UNRWA) and Columbia University Apartheid Divest (CUAD), on his Form I-485. Candid disclosures by the Respondent may have triggered the need for additional information and further processing, involving some degree of discretionary decision-making on the part of the USCIS adjudicator. The evidence shows the Respondent knew of the potential immigration consequences for his involvement in protests organized by varying organizations on campus, including CUAD. The Respondent was quoted in the news stating that he did not participate in the protests during this time because he was worried about the immigration consequences of his participation, specifically that he would lose his student visa. Exh. 7a, Tab E. The Court finds the Respondent’s lack of candor and purposeful failure to disclose complete information on the Form I-485 to be significant negative factors. His involvement, association, and participation with CUAD and UNRWA were such that the truth would predictably have disclosed other facts relevant to his qualifications.

Oh, so he intentionally didn’t disclose that he worked for UNRWA in London? OOPS.

Per her ruling, the waiver in question was never designed to reward lying like a rug on one’s application. Intentionally dishonesty must not be rewarded, because doing so would render the entire application process completely meaningless.

Khalil himself wants us to ignore that this ruling was because HE was committing fraud. He’s blaming everyone else.

“It is no surprise that the Trump administration continues to retaliate against me for my exercise of free speech,” Khalil said in a statement.

“Their latest attempt, through a kangaroo immigration court, exposes their true colors once again,” he added. “When their first effort to deport me was set to fail, they resorted to fabricating baseless and ridiculous allegations in a bid to silence me for speaking out and standing firmly with Palestine, demanding an end to the ongoing genocide. Such fascist tactics will never deter me from continuing to advocate for my people’s liberation.”

When whining is all he’s got left. Better start packing!
