DOJ To Appeal Sentence Given To Attempted Kavanaugh Assassin

The sentencing of Nicholas Roske on Friday was a joke, and the DOJ is righteously disgusted about it.

Carol covered the facts of the case here yesterday, describing how Roske, who now claims that he is transgender, used his newfound “female” identity to try and get a lighter sentence after pleading guilty to the attempted assassination of Supreme Court Justice Brett Kavanaugh. Guess what? Thanks to the Biden-appointed Judge Deborah Boardman, Roske’s gambit paid off. Instead of the 30 years that the DOJ had asked for, Boardman gutted the sentence down to EIGHT YEARS. And he is getting credit for time served as well!

Nicholas Roske traveled from California to Kavanaugh’s Maryland home armed with cache of weapons after a leaked document showed that the court planned to rule against liberals on abortion. Although he had meticulously planned the assassination for months, he had a change of heart outside the conservative justice’s home and called the police to turn himself in.

He has been detained in the three years since, so with time served and good behavior, Roske’s sentence would mean he could be out four years after being sentenced on the charge of Attempt to Assassinate a U.S. Justice. The sentence also included lifetime court supervision.

Boardman said “Under the law I must consider the sentencing guidelines. The guidelines in this case are 360 months to life. It’s important to understand the Supreme Court stance on guidelines… They used to be mandatory, but in [a case called] Booker the Supreme Court held that they were advisory.”

The judge acknowledged that “this crime did involve domestic terrorism,” but undid most of the “terrorism enhancement” created by the U.S. Sentencing Commission to increase recommended punishments in terrorism cases.

“I have not seen evidence that the Sentencing Commission relied on evidence that it would reduce recidivism,” she said. She said recent research in the Georgetown Law Journal said terrorists are not uniquely incapable of being rehabilitated.

Remember, Roske pleaded guilty, AND he had said that he had planned to assassinate TWO OTHER Supreme Court Justices. That indeed is “domestic terrorism.”

Basically, the judge is willing to forgive and pat Roske on the head all in the name of “affirming” his transgender identity. Which had ZERO to do with his motivations for the attempted assassination!

A Daily Wire review of Roske’s postings on Reddit before the shooting shows that he is one in a string of violent trans-identifying individuals who are obsessed with video games and leftist politics. In one, he said he was a “Trans Gamer Girl Seeking Friend.” In another, he said he was “Seeking Daddy to Have Complete Sexual Control Over Me.”

Still another post said “Dating: I am into androgynous or feminine people who use she/her pronouns…. Play Partners: Pretty kinky, have a fet account and everything…. If you are not a cis man, chances are I am interested in playing with you :).”

In one Reddit post, he explained that “I am pro-abortion (in favor of aborting fetuses, not pro-choice).” He said that all babies should be aborted, because they cannot give consent to being born. “This would require no deaths of people already in existence, it would simply prevent new people from coming into existence. Over time, resources would become more plentiful, another benefit of this method,” he wrote.

On May 20, 2022, he asked Reddit users, “The Roe v Wade leak has brought a lot of attention to the supreme court and what it is capable of. If going into the future the supreme court retains the same members, what is a realistic expectation for the future? On the other hand, if a conservative judge were replaced by a liberal judge, thus changing which party has the majority, what would change?”

The next day, he posted in Reddit’s “forensics” forum, claiming to be a novelist: “Writing a killer who is obsessed with not leaving evidence. What methods could they use?”

What did the judge have to say for herself? Apparently this was just a “terrible infraction” but at least the wannabe assassin’s family now can surround “her” with love and acceptance.


On the flip side, the Kavanaugh family – who could have all been the victims of Nicholas Roske – were out of the courtroom the second the lighter sentence was handed down. Who can even imagine what they were thinking and feeling? I hope they go through the formality of getting a permanent restraining order against Koske, just because.


Meanwhile, the mainstream media is falling right into line. Nicholas Roske is now a “woman,” so forget any and all times that they ever reported that he was a man! Never mind that he’s never legally changed his name – he wants to be “Sophie,” so now they will use that name.


Judge Boardman’s sentence is so egregious that the DOJ, via Attorney General Pam Bondi, has already announced that they intend to appeal.

Nicholas John Roske, 29, of Simi Valley, California, was sentenced today to 97 months in federal prison to be followed by a lifetime of supervised release for attempting to kill a United States Supreme Court Justice. The Department of Justice advocated for a sentence of at least 30 years to life.

“The attempted assassination of Supreme Court Justice Brett Kavanaugh was a disgusting attack against our entire judicial system by a profoundly disturbed individual,” said Attorney General Pamela Bondi. “The Department of Justice will be appealing the woefully insufficient sentence imposed by the district court, which does not reflect the horrific facts of this case.”

Roske’s defense team and his family played this judge like a two-dollar banjo. Just because he had a panic attack and confessed before committing a heinous crime does not excuse him from either his political motivations or murderous intent. But the defense played the trans card, and Judge Boardman took the bait. This is beyond ridiculous – it is dangerous.


Since this case was tried in district court in Maryland, the DOJ will have to appeal it to the Fourth Circuit Court of Appeals. Here’s hoping that those judges are less gullible and ideological than Judge Deborah Boardman. I won’t hold my breath, even though the DOJ is doing exactly the right thing in appealing this insane sentence.
